I think I'm all done....

I've been on HD for more than 30 years. But i have hit my limit.  I bought a 2012 FLHXSe3 10 months ago. 9000 miles later the hike has left me stranded 3 times. And has had three throttle bodys and other fuel related issues.
Well, this morning once again the bike leaves me stranded in an intersection. Tomorrow when the dealer comes to get it I'm  asking for my money back and telling him to keep it.
What do you think? Will i get satisfaction?

Damn, so sorry to hear about your problems.  Those things should never happen on a new motorcycle, let alone one that costs $35000. :soapbox:

Depending on which state you're in, Lemon Laws may be helpful at this point.  I don't blame you for being ready to call it quits.

Feel your pain ChiTracker! Sorry about the problems. Are there lemon laws in your state? Do you have a good dealer? Have you got a running complaint log with the Moco? If yes to any of the above, you may have a chance at satisfaction (not sure your money back would be in the offing tho).

Yes, I have a running log with the MOCO, since being stranded in Wyoming during Sturgis. Then each subsequent  problem I have called and gotten them involved. I do have a great dealer (Calumet HD) I know that they will try to do the right thing.
I'm unsure in Indiana's lemon laws. But i will know more tomorrow and post the outcomes.

it must be of the same issue before you can make a claim under the lemon law. It could be different in your state.

Sorry to hear your troubles....I too have a FLHXSE3 and had troubles - a noisey engine (lifters? "usual 110" loud engine?) - for the first 6 months.  Finally on the 10,000 mile service, a loose shift linkage shaft was discovered as the problem, and HDMC replaced basically a new engine! Shift shaft, flywheel, pistons, cylinder assembly, etc.   Even included the fluids of the service at no charge.  I've also had some cosmetic issues - speaker grills, paint on the saddle bag, console 'wrinkle', all replaced by HDMC without issue.   I know the right dealership makes all the difference.   I hope your dealership does right by you.   If not, go higher up.   HDMC shouldn't want to lose a 30yr. customer.   Good luck.

It's doubtful they will give you your money back.  The good thing it is still on warranty and they will have to fix the problem.  You may need an attorney to prod MoCo, to make it a priority to find out what exactly the problem is.  If they put three throttle bodys in the same bike it sounds like the dealer technicians don't have a clue (so they're all bad throttle bodys?  Unlikely).

Maybe you can contact Harley Davidson customer service (if you haven't already).  Keep good notes of all of the problems and statements made by the dealership.  Must be frustrating!  Good luck!

Also doubtful you will recieve a full refund. I know the lemon law here credits mileage against the return/repurchase.

Can you share with us symptoms other than "it left me stranded?"

On two throttle bodies, the actuator/ butterfly would not full close. On a third, they had no clue, so they cut all the wires to the throttle body and extended them a couple inches, claiming tension on the wires might be the problem.
Codes are: P- codes : 0120, 0123, 0223, 0220, 1511, 2135.

I was told that in Florida (not sure about other states) the lemon law does not apply to motorcycles or boats.  :nixweiss:

That is a great service bulletin!  I am a tech that works on GM industrial products that use Delphi electronics, we have a very similar condition to this on our products, the troubleshooting is almost verbatim!

 One would assume the techs would have checked all these things in the bulletin very throughly.  BUT it is more likely that the techs have never seen it.  If it were my bike I would print this and hand it discretely to the service manager!!  just my $.02

In the manual, it states if you cannot reslolve the issue with the dealership you can contact the Harley Davidson Enterprise Contact Center at (800) 258-2464 (U.S. only)/(414) 343-4056.  I have never had an issue of your magnititude so I've never had to make any contact and therefore I'm going by what the manual states.

It's been a week and they still do not know what the cause is. Harley has dispatched a specialist to the dealership who will be working on the bike.
I must say that even when they fix it I'm not going to feel very confident in the bike. I have told Harley MOCO and the owner of the dealership that we need to start looking at an alternate solution. I want my money back or a motorcycle of equal value. We shall see.

To me you have the hottest looking CVO SG out there (Kryto would be #2 with me).  I don't think the dealership will have any problems moving that bike should they agree to do some kind of exchange.  

On the other hand if they figure this thing out you may have a solid bike, here on out.

Well they have found multiple cracks in wires, and bad connections throughout the bike.
And they have done a complete tear down. They have replaced the entire wire harness.
Dealership has to put 300 miles on her before i can have it back.
I guess time will tell.

The Lemon law may not be covered in your state (i.e. Georgia) but you still have recourse.

Look up the Magnuson-Moss Warranty Act.It's the Federal Law that will apply in EVERY state.

To engage this action, you must personally call H-D Warranty Division and state ‘I am invoking the Magnuson-Moss Warranty Act’.Normally, they will send the district rep to your dealership to examine your bike.

Naturally, he may try to make alibies (excuses to avoid blame) but be steadfast and demand your rights.

NO – they cannot deny on the basis of non-HD parts or service unless they can positively prove the connection in a court of law – very difficult.

The rep (who does not have authority to make the decision) will report to H-D and you will receive a reply from the Warranty folks via dealership.

The process normally is required to refund you the MSRP on the purchase less a mileage fee (about $.60/mile)
I have utilized this act on a 2008 FLHTCU and was granted.

READ the Act and understand your rights before the rep shows up – it can save time and show him you are prepared to follow through.

What would cause multiple cracks in the wires  :nixweiss:  This would sure explain your issues with the MC.

They have not offered any conclusive reasons for cracks in the wire insulation. Or a why/ how behind bad connections. Just that that is what was found. They did show me several wires that the technician cut out, and at each bend you could see hairline cracks.
I still want an answer to the question "what caused the cracks/ connection problems" before i take the bike back. But i don't think they know..

I kind a have the same issue with my new 2012 cvo SG, last month I had a noisy metal sound coming from the engine, the dealer ship unmounted the engine which I was not really happy about that for a bike that has only 8000 km, well, they have told me that the lifters need to be replaced, they have replaced them, then they test the bike, and guess what, we have now a higher sound than before, they have contacted Harley Europe and Harley ask them to unmounted the engine again to find the problem. I m totally not happy about that specially for such a bike so, I'm trying with them now to replace the engine otherwise,I'm done as well with Harley.
