Jankalo gets sentenced today.

The Congressman from South Dakota, Jankalow, gets sentenced today for running that stop sign and killing a biker.

If anybody hears the outcome, please post it here.

EDIT:  Just did a search and he gets sentenced tomorrow and his name is spelled Janklow.

It's so sad how he's tried every trick in the book to get off this charge.  It was getting creepy!  Kinda trying to prove "not my fault!"

If it were you or me, there wouldn't be any special treatment.

I think the courts know that a LOT of people are watching this trial and sentencing.

Janklow draws 100-day jail sentence

FLANDREAU, S.D. - Bill Janklow, who dominated South Dakota politics for three decades as governor and then congressman, was sentenced to 100 days in jail Thursday for an auto accident that killed a motorcyclist and ended Janklow's career in disgrace.

After 30 days behind bars, Janklow will be allowed to leave jail during the day for up to 10 hours to perform community service. After he completes his jail term, he will be on probation for three years, during which he will not be allowed to drive.

The 64-year-old Republican was found guilty Dec. 8 of second-degree manslaughter, speeding and running a stop sign for a collision that killed 55-year-old motorcyclist Randy Scott at a rural intersection on Aug. 16. Janklow announced his resignation from the House hours after the verdict.

South Dakota does not require minimum sentences, so Judge Rodney Steele was free to impose anything from no jail time and no fines to a total of more than 11 years behind bars and $11,400 in fines.

The judge fined Janklow $5,000 and ordered him to pay $50 a day for the cost of his 100 days in jail, for another $5,000. The former congressman was ordered to report to the county jail in Sioux Falls on Feb. 7.

During the trial in Janklow's hometown, the jury saw him in tears as he described his grief over the crash. The defense argued that Janklow, a diabetic, had not eaten for 18 hours and was suffering a diabetic reaction that left him confused and disoriented.

A prosecutor called the scenario "goofy" and said Janklow concocted it as an excuse for going 71 mph in a 55 mph zone in his Cadillac.

Janklow was state attorney general in the 1970s before serving a total of 16 years as governor and then winning South Dakota's lone House seat in 2002.

Over three decades, Janklow charged ahead with his vision for the state, winning over voters in heavily conservative South Dakota with his tough-talking, often abrasive style.

He made South Dakota a major center for credit-card issuers such as Citibank, saved rail service in most of the state, and used inmates to wire schools for high-speed Internet access.

But he also made many enemies over his unwillingness to compromise, his insults and attacks on opponents and his penchant for cutting corners.

Janklow made no secret of his need for speed. He received 12 speeding tickets from 1990 to October 1994. A month later, he was elected to the third of his four terms as governor and never received another ticket in the state.

"Bill Janklow speeds when he drives - shouldn't, but he does," Janklow said in a 1999 speech to the Legislature. "When he gets the ticket he pays it, but if someone told me I was going to jail for two days for speeding, my driving habits would change."

Janklow would have been up for re-election next November. His resignation from Congress became effective Tuesday.

A special election will be held June 1 to pick someone to serve out the remainder of his term, giving Democrats an early chance to pick up a seat in the narrowly divided House. The seat will remain vacant until then.

The Republicans will gather Friday and Saturday to select a candidate. The Democrats will meet on March 6 and are expected to tap Stephanie Herseth, who narrowly lost to Janklow in 2002.

i hope there is a civil trial and he has to pay the family big bucks for support wife,kids etc,etc,etc,etc,etc, --ak

100 days, huh?  That's about 2 days per year of a biker's life!  

Doesn't sound like justice prevailed today.....

I like the fact he gets work release after 30 days. And you know that the former governor won't be in the general prison population.

I hope that the citizens of the State of South Dakota act to remove the judge in the sentencing of Janklow today.

90 days and $5,000 fine is absurd to say the least.  It was a human life that was taken due to years of disregard by Mr. Janklow for the laws of the state and the people of the State of South Dakota and for human life.

He should have been sent to prison not the county jail.  The time sentenced should have been reflective of the crimes and disregard shown by Mr. Janklow......he should be sentenced to years, not days!

His licensed should be revoked permanently, based on his defense alone.  He claimed that it was a diabetic reaction.  He could have one of those at any time in the future, therefore, he should never be allowed to drive again.

The sentence today is an outrage!

I am wondering if thre will be any rally/protest/ride or whatever at Sturgis to protest this.  If this is what the State of South Dakota thinks about motorcylists, I'm not sure I want to ride there anymore!

South Dakota makes a ton of $$$ off the Sturgis Rally. and I know the Rally has swayed legislation in that state.  For example, they would love to have a helmet law but the legislature is worried that if they enact one, it will hurt the Rally.

My point is I think the Rally can make a statement the folks there will listen to.  Will it change anything...probably not, but you know it will be heard and a ride into Pierre by a hord of bikes will get plenty of press coverage as well!

As for JCZ's question, I started riding when I was 14.  I'm now 56!

So we've been riding just about the same amount of time......which state is it that you think we're treated any different in?

The state of South Dakota charged Janklow, tried Janklow and found Janklow guilty.......one person, a judge....judge Steele is the only person that had the responsability to decide Janklow's sentence.  It was not up for discusson or vote by the people so how is it related to Sturgis?

You want the media involved, write to the media....thousands of people are doing it.  I walk my talk, I've wrote my letters......I also wrote the Governor of SD (what ever good that will do.....he can't do anything).  The judge needs to be removed from the bench.....boycoting Sturgis sure isn't going to get that done.  There's no corolation.

You are putting words in my mouth. JCZ.  I never said anything about better treatment in other states nor did I say anything about a boycott.  (Hell that would just hurt the people in South Dakota including many motorcyclists.)

All I am saying is that a "ride" during the rally, like there are so many other "rides" at the rally, would make a great statement of both support for the Scott family there and a protest of current laws in South Dakota (and in other states) in cases such as this.

It's not the judge who needs to be replaced, it's the laws.  The judge was actually very consistant with the current laws of South Dakota when he sentenced.

The folks who have the best handle on the laws there and who have the best chance at changing them are those of ABATE of South Dakota.  I walk my talk by supporting and working with them.
