IMO, every video that I saw of that incident showed Stewart blapping the throttle and sliding towards Ward just before he was hit.
Anyone who is as familiar with driving a high power high-stagger race car as Stewart is will know full well that when you blap the throttle the rear will jump to the right.
Stewart made an intimidation move that went wrong.

Tony did NOTHING wrong. Blipped the throttle while turning away in an attempt to miss, not to intimiadate anyone. It takes throttle to steer a sprint car quickly. Hopefully legal system will shut this down quickly, young man who thought he was going to show national celebrity his  disproval of situation, paid for his quick stupid move.

I was talking about this with a stranger at Wendy's this afternoon.  Had missed it on the news prior to today.

The whole mess is course just sad.  But none of us can know what went on in Stewart's car or his head.  I've "steered" on dirt with throttle.  Many of us here no doubt have.  But whether Stewart was steering to scare the kid or just steering we can't know beyond what Stewart has said.  There was likely whatever is the local version of a coroner's inquest so the question was asked.  It had to have been answered satisfactorily enough so that nothing came of it. 

Given all the circumstances that are known to this layman the civil suit seems a stretch.  But a grieving family has a logic that isn't always apparent to the rest of us. Even there we can't know whether it's a, perhaps, desperate attempt for some sense of closure or a case where a family (or family member) just feels the "rich celebrity" will throw some money at them to settle rather than contest the matter.

No matter what else happens there are only only a few things that are certain.  The kid should have stayed in the car.  The kid is dead.  That is sad.
