I just read the article, so sad that something like that happend. I hope the bikers will be OK.
I am not sure about the laws in that state but in many states there is a difference in "Criminal charges" and "traffic code offenses" issued during a traffic accident investigation. Most of the time on serious accidents they will wait for medical reports on the offending driver and the victims before charging, many times the decision is made by a prosecuting attorney not the officer or trooper especially if there is a death involved.They may delay charges some to see if the victim is going to die so they don't charge the suspect with a lesser charge and after that conviction the victim passes because they can't try the person twice.
Generally they will not charge someone with a criminal charge if they had an "Unknown medical condition" that was not foreseen. If they acted negligently though they could be charged with manslaughter if someone dies.
That all being said, that doesn't mean that the person won't go to court for the accident. It may just mean that the prosecutor feels that nothing criminal happened and it falls under the traffic violation guidelines and the person can be charged with a violation later and taken to traffic court to answer for what they did or failed to do properly. If no one dies it may fall under reckless driving which may not be a criminal charge in that state.
There is also civil court actions that can be taken by the victims to attempt compensation too.
