The question you probably need to ask yourself is this the bike of my dreams. Its has miles on it yes and could be looked over to get the relative shape of the motor. To buy looking as a investment will lead to a disappointing result. If the bike is somewhat stock would you leave it that way or would you be spending the money anyhow to modify.

As others have said, it's not a great price if it's not what you want, but not a bad price if the silver 09 is what you want to own.

I own a yellow 09 and it's the bike I always wanted to own. For me to sale it would take way more than that $16,000.

I don't know how anyone could make an educated decision without all or at least most of the facts. I mean 120K means that it has probably had a bunch of work done along the way but the questions are aside from physical condition, what work has been done and when and at what mileage and what parts were used.
As was mentioned earlier, if you are serious and none of that info. is available, get a 3rd party involved to inspect the bike thoroughly including a compression test and listening for valve train and compensator noise and tire, belt and pulley wear/condition and a test drive by said 3rd party to determine suspension, clutch, tranny and such. You could use an Independent or a Harley dealership. I would think if you ask around on this site that you could find a member that could help like GMR or someone down there in Texas.

Title states clean. Looks to be in great condition for the miles, obviously someone took care of her.

You don't think he'll take it to a dealership to get a compression test done?  Not even if you're paying for it?  With over 100k miles he should have done that.  Not sure what makes you think he will not but it would not even be a consideration for me, if he's not willing to get that done.

I totally agree, I bought a 09SERG Electric Orange  4 years ago This was the bike of my dreams back when it came out. Granted I have put some $$$ into it but for me it was well worth it. I had thought about selling it & getting a BMW Bagger but no one would come close to paying what I was asking. Which is ok cause I love this bike, besides wife’s says to me the other day “Just buy the BMW & have two”

Unless you are committed to keeping it "forever" I would not buy it.  Sticking with a lower mileage one that others will buy is a much better investment!

What is "12,0000" supposed to be? 12,000 or 120,000?

I have to agree with the owner, and per this site it is not a popular opinion, but I would not take my time to go to a dealer, have a compression test or anything else. I have sold over 50 cars/trucks/bikes and have had requests like this, never did I even consider it. He is selling the bike, honestly or not, and you are buying. Up to you to decide if you want it. If you don't buy it there is always someone else. I can not tell you how many who wanted dealer checks, they didn't get, eventually bought and paid my price.
On the original question. I had one of those hot running, abs problem, lowers don't fit without changing fairing bracket, did I say hot running beautiful bikes. And NO WAY would I buy one with that many miles. To many out there with acceptable miles.

I think, but not certain, they're talking about 2 different bikes.  Fishdoktor's bike is in TX and has 120Kmiles, while Ultra13's buddy is probably around Ohio and only has 12Kmiles.  That part confused me at first, and not absolutely sure now. lol

If you buy that bike with that many miles on it, you will be stuck with it for life.  I would never do it.    Stuart.
