Title: Finally decided to post this............
Post by: Robmay on December 02, 2006, 09:55:01 PM
Well............... This past Thursday afternoon I left from a gas station after just filling up. Headed west on a 4 lane highway with no median. I came out and took the inside lane as I was approaching an intersection and the right lane is a turn/staright lane. I notice the cross guard is flashing and showing 14 seconds left before yellow so I have plenty of green and go ahead and accelerate and shift on up. Right as I get into the intersection the car just ahead by a half car lenght and to the right of me in the outside lane cuts into my lane to avoid hitting a truck that failed to yiels the right on red and cut into her barely tapping her rear passenger side door. She was there in over half of my lane. I had no choice but to hit the left front of her car as my only other option was to hit the cars waiting to turn left (facing me heading the opposite direction).

The right front leg faring and crash bar hit first (and slightly into my right leg), the the passenger floorboard was the next to go and it flew into the side cover and then the lock side of the touring pak. Then the saddlebag guard and the saddle bag hit her front tire pushing it up towards the tour pak. Sp pretty much the whole right side will need to be replaced along with the gas tank (the leg faring pushed up into that as well). The lady driving the truck that caused the whole mess ended up leaving the scene and was never caught. No citations were issued although the girl that veered into my lane was at fault for my damage according to my insurance company. They said to take my bike wherever I wanted and get the process started. I took it to my local dealer. My insuramce company (Markel Bike-Line) called the next day and gave me a claim number and let me know they will pay for the damages less my deductable ($500) and then submit to her company for reimbursement for their cost and my deductable.

I went to the Express Care place and got an xray of my leg to be on the safe side. Although I hated the wait I was glad I went as the little bone in my leg (tibia??) is broken in two places. I will get some kinf of air boot Monday for it. It hurts some but I can walk on it fine.

Lady that left the scene was about 40 ish with a male passenger about the same age. The girl that i tangled with was about 23-25. Very nice young lady that kept her head (besides coming into my lane  :)) throughout the whole thing and was very apologetic.

Those that have been down and those that are going down is the old saying. That being the case, as bad as this was, it most obviously could have been a whole lot worse. Sorry to see the bike beat up and you as well. Glad you're ok and the bike is on the mend. You need to make a claim for whatever other loss you suffered as well against the young lady's insurance. You shouldn't get stuck with the $500 deductible. Did you lose any gear ( boots, pants, gloves, chaps, jacket etc.) I'm sure you've got your medical bills going to them. Did you miss any work. A whole lot of issues. My advice is to avail yourself of an attorney for at least the first consultation. 99% do the first one free. Lay it out to him/her and see what they say they think the total value of the claim is. Hope the leg mends quickly and your Blue Jester is ready and waiting when your leg is healed.

No, Elvis is an 03 Golden SERK, named Elvis by my best friend and brother Screamin_Beagle (Matt) since it's gold and over the top. Bunch of pics of it over in the ride section under nice ride. The Orange Road Glide is mine too. Mentioned it since it seems you might be thinking about one. You won't regret it.

Well............... This past Thursday afternoon I left from a gas station after just filling up.

Rob, since this happened on Thursday you really need to have a talk with Spider.  On the prior Tuesday, right here in the tombstone/destruction/dented-fender section of the board he wrote this:

Quote
The last new incident under this board was a post from... 8/23. That's two months ago.

He jinxed you Rob.  Plain and simple.  You had a hex on you and it came from Maine!

Also, and fare more importantly, glad you're ok.  Said it before and will say it again; you're fine, you pretty much walked away, hell; the bike ain't even all that bad.  All that being so, the rest is just parts and don't matter at all.

Rob, glad you were able to keep your head and the bike upright.  You opened that car up like a can opener.  Good thing it tore away so easily or the result may not have been this good.

Speedy recovery on the leg.

Let us know how the list comes out at the dealer, that is going to be some serious money.

From the looks of your pics and the color of her car explains it all! She obviously looked in her mirror and thought the blue object in her mirror was part of her car. If she was driving a red car she would have seen ya! [smiley=huepfenlol2.gif] ;D

Pray that your leg mends quickly and your scooter too! Good luck on the RG! It really changed my mind seeing Brians Los Dragon and Otis's in MV. They are sweet!

I agree with others in that you should not have to pay a deductable when the other person is at fault. All expenses should be covered by other's insurance unless you are in one of the "No fault" states.

This could have indeed been so much worse!! That is the biggest reason I am taking it all in stride because I know that I am truley blessed in this situation (hopefully I won't be singing a different tune when it comes to dealing with the local dealer, MOCO and the insurance companies!!)

Not sure why I would need a lawyer at this point. I am a big believer in sowing and reaping. As long as the insurance does what its supposed to do then all should be well. Thats why they call them "accidents" and not "on purposes"  ;D I am just so glad that no one was hurt too bad!! Thanks again for your concerns. I do have an attorney I use that is also a good friend. I will call him should the need arrise.

I'm sure the deductable will be paid by her insurance company. Did not lose anything else. I did get a paint scrape on my inside right pant leg. Not sure how that got there but it appears that my pant leg was pinched somewhere amongst the mess at some point.... yipes! Close call.

Mrs.WeCVO,

I'm sure I am not the only one around here that has often wondered "what if"..... what would I do? How would I handle it? Can I really be prepared for a situation like this where you have absolutely no control other than to take the lesser of two evils so to speak. Will I keep my head? Will I be paying attention, etc. I can tell you I am truely blessed!! I would lkike to take the credit but there have been some times when I was riding that I kinda "zoned out" and when I "came to" shuddered to think.... what if a car or dog or deer had run out it front of me durring those few seconds?? Scarey!! I'm glad I had just pulled into some traffic from getting gas so that I ws paying DULL attention. Otherwise.........???

Thanks for your prayers and well wishes!!

Just want to echo the already said "get wells" and also that it could have been much worse.  Don't know about Ocala but down here you really have to put your radar on maximum sensitivity and range because there's no telling what the drivers will or won't do, regardless of their signaled intentions or lane choice.  I stick to the backroads, myself.

Again, glad you're OK.  Bikes can be fixed much easier than people.

Rob,
Glad to hear you're okay and the bike isn't too torn up.  You may find you mend much faster than the bike.  I was in my dealer yesterday, chatting with them about my parts manual I have on order.  They told me that the manuals aren't supposed to ship until the first part of JANUARY!  Nobody has ANY parts manuals, dealers, nobody!  That was my exact sentiment to the parts manager- what happens if somebody goes down???  Essentially I was told they have to wait until parts manual comes out before parts can be ordered!  I hope that's not the case, but I'm not sure how anybody can order the painted stuff without the correct part numbers.   Wishing you the best for a speedy leg recovery and a speedy bike recovery!
John

Rob,
Glad to hear you are OK.  That little bone in your lower leg is a fibula.  I'm not a doctor, but I did stay at a Holiday Inn Express last night.   ;D  Just kidding.  The only reason I know that is because my daughter had a bone graft almost two years ago, and her left fibula was harvested and used as the graft bone.  It is amazing what those medical folks can do these days.  She walks very well without it.  Anyway, just wanted to pass along my well wishes.  Best Blessing to ya Bro!

Funny you should post this as my foot Dr told me the same today. He was a little miffed that the express care place let me go with a prescription for an "air boot" and some pain pills (neither of which have been filled yet as I am too busy trying to get a replacement ride... ;D) seriously though, the places they sent me to do not have such a boot. My foot doc said to bring him the erays asap in the morning and he will determine what I need and he can put a removable cast on it right there if need be (just remove to shower and , ..er.... ride...).

Not to short change everuone that has posted but I am sure everyone is tired of me takking up web spave and strecthing this thread out with all the individual replies...... Thank you all from the top and bottom of my heart for all of your kind words and gestures of good thoughts, prayers and well wishes!! It really means so much to me. This is a super place. Never seen anything like it. No bickering and name calling, just good old fashioned advice and opinions and experience. I am so lucky to have found this place!!

Very glad to here you're okay,
 but your jester looks bad

Rob,

Having shattered the Fibula sucks but the good news is its not weight bearing.  From current experience I can tell you to go buy tennis socks (peds ?) that only come up to your ankle bone.   If you wear tube socks they will dig in a bit and really aggrivate you.

Glad your doing ok and sorry to hear about bike its a shame, but the good news is that it can be fixed and your here to tell us about it.  Nice job keeping it on two wheels that is a feat in itself.

Get well and I feel your pain literally :)

I echo what Harry posted above. I'd recommend getting a consult with an ortho-surgeon just in case, those fractures can really cause havoc if not set properly and the socks/pain killers treatment is lacking it seems.

Hope you have a speedy recovery.

Whoa Rob!!  I don't know how I missed this post!

I'm glad you're OK!  Sounds like you did a great job of saving what could have been a much worse scenario.

Having been there myself, one thing is for sure and that is sheet metal, plastic and chrome can be replaced.  Thank your guardian angel for the assist on that one.

Best wishes on yours and the Smurf's return to action!

Scott

No sweat Scott! Could have been a lot worse. I am so thankful it was pretty much the bike that took the brunt of it all. Thanks for the wishes!

UPDATE! So far anyway. My collision rep at the HD shop said he was able to get the parts numbers for the painted parts and finalize the estimate. $7,300.00. Since that amount is over my insurance companies $6,000.00 "no look limit", they are sending an adjuster/rep out sometime Monday to look at her. My HD rep said that if the third phase is still in production it may work out in our favor as far as the time thing goes. I told him that as much I was aching to get back on my Smurf, I was going to purchase another bike to ride as a "spare" so I would not be rushing it. He said he wanted to get her back to new and perfect condition for me. So far he is saying all the right things anyway.

On the "spare" bike note. I TRIED (again) unsuccesfully, to purchase my spare from my local HD dealership (the same one that has my bike in for repairs). They are running a promotion for $1,000 below MSRP. Maybe if the sales manager, finance guy and GM wouldn't treat most people like a peice of Sh!t, they would not have to do that. But thats just my opinion.

I mention to my sales guy (great guy as are all the sales team there) that I may be in the market for a Road Glide to ride as I plan on my Smurf being down for at least 3 months. So he calls me Saturday and says come on down and lets work out the numbers. So I head down there and long story short (I know, too late for that) we ride a used one with 3200 miles (05) and a new one. New wins mine and my wifes vote hands down. Since they are $1,000 under MSRP I opt to try for that one.

So I pull the sales manager and my sales rep aside and ask for them to swap the wire wheels with some basic black ones as they charge $450 for the "upgrade" of the wire wheels (I am not a big fan of wire wheels because of the cleaning and tubes in them). They normally charge $200 to do this. I ask him to do it for no charge and I want free freight ($335 charge) as I have bought 3 bikes there in 3 years and have 3 freinds I referred that purchased 4 bikes between them over the last year. He said he would swap the wheels if I went with the black spoke and not the silver for no charge but could not do anything on the freight without checking with the owner (BS, but okay I'll play along). I told him that I would finance thru him if I could get "free freight".

Monday morning first thing my sales guy calls and says they will knock $100 off the freight and the swap for free. I said I will take the deal but I am getting my own financing as my deal was for "free" freight right? He said you are correct. So we ran thru the numbers on the phone and hung up.

When I went to buy the bike Tuesday evening, the numbers were off.  ::) They were trying to charge me for the wire wheels. So the finance guy gets the sales manager (who was in the very next room listening to the whole thing) and I leave them to sort it out.

I go get some popcorn and hang out with some of the other guys. A few minutes later my sales guy comes to get me. When I walk in the room the sales manager starts ranting about the deal and that he told me he would waive the LABOR on the swap NOT the up charge for the wire wheels ::) So I said "look Mark, thats not the deal we made Saturday. Why would I want to pay for an "upgrade" that I was having you take off?" So he swats the paperwork across the desk and storms out of the room past me telling the finance guy to take it off and something about $100. So I say thank you and of course he says nothing and the deal resumes.

The numbers are still, slightly off. They were now trying to charge me full freight. I told the finance guy that the deal was for $235 on the freight. He says "OH NO! YOU SAID "THANK YOU" WHEN MARK SAID TO TACK THE $100 BACK ON THE FREIGHT!" I said "look Kenny, I did not understand half of what Mark said when he huffed out of the room and YOU were not there Saturday when we made the deal so you need to keep your mouth closed about it." So then Mark storms back in and I ask him about the freight. He said "I'm not giving you the hundred off the freight if you are not paying the $450." I again said "The deal was simply this: swap the wheels for black aluminum ones therefore taking the upgraded ones off, no chage on the swap and $100 off the freight." He and the finance guy then started ranting between themselves and the finance guy throws his pen across the desk and says "We're done! We're done!" So I asked my salesman to excuse me and left. I stayed and tried to work it out. Some of the other staff tried to get the GM to speak with me and he asked them "what I was whinning about?" That was it. I left.

Sooooooooooooo................. I went back to the FINE folks at BRANDON HD (100 miles south) and bought my spare bike last night!! Their PDI is $200 less than my local delaer, includes the 1000 mile service and I got a GREAT deal since this was only the second bike I bought from them in 2 months. Mike Rendine (Internet Sales Manager) has done nothing but bend over backwards for me. All the folks at the Brandon store last night were out of their way freindly and helpful! Hats off to them all!! I cannot say enough about them all! Really. I'm serious.
So without further ado.........

I even reminded them of that when they were treating me coo-coo over $100. Didn't matter. However, I have had some shakey times (like most here) at the service department. Showed my a$$ once or twice (thats why I tried real hard not to in this case). But the service manager and shop forman have looked past that in past dealings and we have really worked at building a relationship. Partially because of that and becasue of Terry (the man handling my repairs) I will leave it with them. Terry has worked hard to get the estimate up even after he was told it would probably not be doable until sometime in January when the parts catalog finally came out for the dealers. He found a way to get the numbers elsewhere and get an estiamte done. When I stopped in un-announced he took me to my bike and went over all the little things he saw and asked if there was anything else I needed done. He assurred me he wanted it back brand new as that was what it was at the time of the crash. So I feel good about it so far. Hope I do not have to come back on here and eat these words [smiley=huepfenlol2.gif], but I really think I won't have to. I was VERY tempted to go up there the very next day and pick it up though.... VERY....

Thanks Mrs We. I was a little concerned with the length of it but when I got done it didn't seem as long as it took me to type it (one finger hunt and pecking)!!

Anyone that knows me thinks it is a miracle that I did not get at least a little crazy! Probably due to the fact that I was by myself and there was no one to show off for! [smiley=huepfenlol2.gif]

I did give them evry opportunity to save it. Even had my salesman make that call the morning after to see if calm heads would prevail but nothing doing. I am SO GLAD that I stuck to the agreement because I am SOLD OUT to the folks at Brandon HD (they own 3 dealerships, Brandon, Tampa and New Port Richey)!! They treated me above my expectations which is more than I was looking for. That is how you cecome successful in a service related business IMHO!!

Sweeeeeeet Road Glide.  Damn shame some people in the customer service business don't understand they are serving customers and should feel privileged that you are in their establishment.  Good luck with the new ride and great to hear you're back on two wheels.

Rob, good for you man! These guys need to understand that, as their valued customers, they need to treat us with a little more respect. Some of them think they can get away with that "Good Cop, Bad Cop" or "Bait and Swith" routines. Some try to treat us like a bunch of idiots that don't have a clue, and will do anything they say because we want and love their bikes.

On the "spare" bike note. I TRIED (again) unsuccesfully, to purchase my spare from my local HD dealership (the same one that has my bike in for repairs).

So in a nutshell they were willing to lose a sale on a new vehicle to save $100.00?  Unbelievable.  Even if the honchos were as a big of dicks as you describe the salesman should have bright enough to save his commission by pulling a hundred bucks out of his pocket, hand it to you and say "hey man, I apologize, I don't understand it either, but this evens out the deal."

Congrats Rob........was the first dealer OCALA?....thay are very difficult to deal with!!! I like so much this Road Glide......are you panning to upgrade to 110 kit? When are you coming over?

Ride safe mi amigo,

Jorge

Jorge,  Yes that was the dealer. I went there yesterday to pick up a backrest pad for the Shark and the sales manager wlaked by while I was talking to about 4 of the salesman and looked at me and turned away without saying a word. Then later walked right by me going into the buildin (within 3 feet) and again said nothing. some of the sales people want me to send a letter to the owner. I told them I probably would but that it would not mean a thing. This salesmanager has been this way for a long time. I am sure the owner has heard about him more than once by now.
I'll let you know when I can get your way!!

HB,

Thanks! You are absolutely right. There are some good ones out there though, you just have to hunt around for them (though for the prices they charge you should not have to).

Emotions could have impaired your judgement while looking at that new RG on the floor. I agree. A deal's a deal!. It's not the 100 bucks, it's the principle of keeping your word and not taking advantage of people's emotions when they make a purchase like this. Same thing happened to me 2 mos. ago when I made my first deal on my SERK and I told the to shove it when they tried to alter it. I told them that I'd rather stick a 124" and 6-speed in my '03 before I'd by that SERK from them (not a bad idea). I took the deal to another dealer and they seemed happy to accomodate me. But this dealer was the same one I had to tell to shove it in '02 when they had the order for my '03 RK. At pickup they tried changing the deal. I got my deposit back and went 200 miles upstate and bought one off the floor. They're under different ownership now, so I hope they act "stand-up" this time around. I made sure I told them what happened last time too. So I fully understand what you went thru and commend you in not folding. Getting off my [smiley=soapbox.gif] for now.

More importantly, congrats on your new RG. It looks really good. If I wasn't a RK guy, that would be my next choice. Plus no CVO RG this year. Good luck with it and I hope these morons realize that they're about to lose another good customer. A CVO owner at that. Don't they realize that CVO owners will spend and do more to their bikes than anyone else. Fools!

I'm glad you're feeling well and take care of that leg. I hope they do right fixing your bike.

Hoist!  8-)

Hoist,

Thats the whole problem. They don't. Its a shame cause the sales people, parts and clothing staff ALL do. Thanks!!!

Crazy ain't it?? Even if the salesman had done that it wouldn't have mattered. He knew when this happened (third time for me) this time it was a matter of how I was being treated and I was done.

Just read about your accident, what a great job in keeping the bike up!! Amazing, given the damage to the crash bars and such. Hopeyou and the bike have a speedy recovery.

Sometimes these dealers have real dorks working for them. I guess some like it that way. I have a paper that I carry in my tour bag all the time. It is the local sales managers BAFO on an 06 CUSE. I have copied the numbers from the dealer I bought from and not only did he beat the local deal significantly but I got an 07 cheaper that what they would deal on an 06. I tried to deal with the guys in Crystal River in the 2002-03 timeframe and I wasn't impressed at all with their deals. If I were to buy a new bike in this area, I would go to either Brandon or New Port Richey.

I was sort of up your way last night. The Mrs and I went to the Gretchen Wilson/Blake Shelton concert at Rock Crusher canyon in Crystal River. Got pretty cold, ~50. We were able to try out the heated grips and seats. They all worked and we had a good time.

Give me a shout sometime and we'll get together for a pop.

Don,

Same owners as Ocala. Thats why I told the sales people that I don't think it will make any difference if I send in a letter. The owners may inquire but the GM or sales manager will just say I am a Whiner and that they were already giving me the bike at $1,000 below MSRP and blah, blah, blah and that will be it so I don't think I will waste my time. When I take my Butt and my Buck elsewhere, that will speak the loudest.

I camp at Rock Crusher every summer when the scallops come into season. Well, I did one summer anyway doesn't that count for every summer?? [smiley=huepfenlol2.gif]

Let me know when you get up this way again and we can hook up for a "pop" of maybe even a diet coke!! ;D

Mrs We- You nailed it. I was born and raised in Western Pa. We have lived in Fl since 1990.

Growing up, a "pop" was a soda. Then a "pop" became a beer. Even today, my older brother refers to a "pop" as a beer. When he says"let's get a pop", he doesn't mean root beer.

Rob,

Personally if they (Ocala) treated me that way as you have stated,  I would have had the trailer there that night or the next day and if your asking opinions my opinion is take the bike out of there no matter how hard Terry has worked unfortunately he is the victim, but why give the dealership the 50 percent markup from your insurance company.   Let the good guys reap the benefit for treating you right without having to make you feel the way you did at Ocala.

Just my thoughts on it.

The part of your story that is infuriating is their attitude towards you, not so much the $100.00.  I always push hard for the best deal, and if they don't go where I want to go, it gives me the choice of accepting what they offer or going elsewhere.  As long as they treat me like a customer and are respectful, I am fine with not always getting the deal I would like - because like I said, it becomes my choice to buy or not.  However, the first time papers flew across a table or name calling (whiner) commensed, we would have a whole new problem.  The gloves would come off and they would never see my money again.  Calm hard negotiating is one thing, but childish disrespectful behavior crosses the big line with me....

I am glad you bought your RG elsewhere - if it were me someone else would be repairing my SEUC...  I am glad you survived your accident with relatively minor injuries.  Things happen fast to the best of riders, don't they.  Good luck...

Harry and Scott,

I think you are absolutely right. Do you think there would be a charge for what time they have put into the bike up to this point and if so I guess I would be stuck with that. Guess they could get nasty about it on that end. What do you think?

Hanging on the wall at the local HD shop is a sign that states estimates will be charged at $75/hr. If it were me, and it is easy to say, I would pick up the bike and take it to Brandon HD where you are going to have a lasting relationship. I'd suck up the costs and move it.

Rob,

What did you sign?  If nothing than I can't see them charging you they forgot to do the paperwork oh well.   You might expect them to try and charge you for the estimate ok so you eat that might also try and charge you for the storage, but its not your fault parts aren't available.  Your insurance company may be able to help also.  They usually write the check to you and the dealership if its someone elses insurance the check generally goes to you the owner of the bike.  Not sure how this one works out, but its good to know those small details ahead of time if its already been paid out.  In my case the insurance company paid for the estimates / storage.

I would also inform them that when they changed the deal on the bike you were buying they changed all the deals, when they threw paper work across the table at you they changed the relationship, when they belittled you they chose the disrespect.  Can't do business with someone I can't trust, cant rely on and don't respect.

If you didnt sign anything its easy if you signed something it may cost you a few bucks short term, but sounds like if your asking your already soured enough to sever the relationship.   Hopefully its a big enough statement that it gets back to the owners and many others find out about it.

Also when my wifes bike was hit we were able to work out over a 10 percent off on parts deal I would check with Brandon on that as well :)

Yes on both accounts. I was too far along on the repairs. Would have cost too much to move it. Plus Terry is a heck of a good guy to deal with ..........so far. I feel good about him. I stopped by and talked to him today and he really takes the time with me and my perception  (which is what matters at this point) is that he really cares to get it right.

After I took my road glide by I went back with a box of Saint Luis Rey Cigars and handed one to every person there (except the GM). When IO went to the finance guy I gave him one and said "no hard feelings." He said (hanging on to my hand shake) "hell man your gonna still buy a bike from us"............... I said (in my most humble voice) "sorry man I bought one already in Brandon from the same folks I bought my SE from". He said "no way at the same price?" I said "yep. they matched the price and gave me 20% on some upgrades I made". The look on his face was well worth any letter I could have written. I thought about sending a link to the owner so he could read this post. I saw him today while I was there checking on the Smurf (she sure looked pretty, had to give her a hug while I was there).

You know, there may be rotten apples in the barrel, but it does not mean the whole barrel is rotten. I am proud how you have handled yourself and am so happy that you are getting the service that you want on the repairs.  The GM is not wrenching on your bike, so ignore him and keep those great relationships with the rest.  It is easy to walk away from the whole business, hard to use just what you want.  You are doing what works for you and that is all that matters.   [smiley=xyxthumbs.gif]

Okay!! Got a call from my dealer....... well not mine the one here in Ocala amyway  ;D and he tells me my bike is ready except for the filler peice between the saddlebag, its still on back order. However, the bent the other one back straight and reinstalled it while they are waiting on a new one. Also they ordered a new clutch cable as it was slightly bent. Its still functional so I can ride the Smurf again!! I think they did a fantastic job in the service department there at Ocala HD! Bike looks and sounds awesome (i took the V&H ovals off and replaced them with the kerkers I bought for the RoadGlide (Spare Shark). Man that puppy sounds off now! I will try and post some new pics below. Hopefully the pic thingy still works the same!

The only thing I found that needed tweaking was the handlebars seem to be slightly lower (athough it could be due to the feel of the Road Glide) and the trunk would not seal (pic below) which was a quick fix with a minor adjustment and now is sealed fine.
