Harley lemon policy
« on: March 31, 2008, 11:57:55 AM »

Does anybody know for sure, not third hand, that h-d has taken a 110 inch cvo bike back and given either money back or credit for a new h-d bike?  I don't want opinions or you heard it from a friend of a friend or your second cousins sisters husbands brother...actual first hand knowledge please.

FYI: if they did it likely included a non-disclosure clause so not likely to find out. However what is not known by most is that any non-disclosure langauge in most states lemon laws automatically renders the agreement VOID as a matter of public policy. Good luck

Most state lemon laws require the bike be down (unridable) for a period of time before they apply.

Substantial impairment to the use, value or safety, as well as days out of service as well as 3 or more attempts to repair same or days out of service exceeded for multiple reapairs within the warranty period. The real threshold for trigger is Substantial impairment and days out. BEWARE of the UNABLE to Duplicate customer concern defense :soapbox:

I think Harley's "Lemon Policy" is to tell you to go make lemonade.

There was an individual on this site who mentioned having H-D buy his bike back.  Unfortunately, due to the nondisclosure crap, he wasn't able to give details.  Unless someone remembers which thread it was in, all I can suggest is to try searching.

I have used the lemon law in the state of Washington and it must be a safety issue. My case was not against H D but with another Big twin mfg. My experience the dealer will drop you like a hot rock when you tell him you want to go for lemon law and then it's you against H D. My case took about 6 months and I had to work my ass off to get paid for the upgrades I had put on.   :-\

lemon laws are regulated by the state that you purchased or registered the bik in.
hence here in massachusetts recreational vehicles are lemon law exempt.
this means that the only warranty protection you have is harley's warranty.
however if you become the wheel that needs a lot of grease and get a certified letter
to an executive that feels the need to protect there good name you may be able to plead your case.
