Would you call this false advertisement?
« on: September 14, 2011, 07:21:44 PM »

I found this listing on Cycletrader.com and emailed them. I got a phone call today from a sales person and she said they actually don't have this bike in stock and doesn't know why it is even on cycletrader. I told her I felt like it was false advertising in my opinion. I felt like telling her thanks for waisting my time......LOL :nixweiss:

If they don't have the bike that I would agree. It's just phishing for leads.

How many people do you think saw the listing and drove to the dealer without calling first? At least she told you they didn't have the bike.

I believe it is false advertising. They know what to put in the ad to catch our eye.

We should blow up thier phones.  5 minutes from each of us would keep them tied up all day.  Call them out on the false advertising.  Might be the last time they try that trick.

Perhaps not completely false, but certainly misleading advertising.

Well, although not good practice its common practice whether it be motorcycles/cars or what have you. They were careful not to put in their ad, in stock for immediete delivery.Misleading yes, false no.

Well, they do not say is "in Stock". so they are advertising the bike and want you to call them to hook you with something else. Tricky but I would not say is false advertisement.

Why could this not be a "presale" attempt?

They may be getting one or more and want to build a list............

I would not consider this false adverstising any more than a Harley Website is false advertising

I have seen several Harley dealers use this format with the MOCO brochure photos and spec sheet.
I noticed too at the bottom where it says "more from this dealer" you can see all the brochure photos for the 2012 lineup so I guess it would attract anyone looking for a 2012 Harley.
I have mixed emotions about this practice, I would prefere that dealerships only photo and put in ads for what they have in inventory but I guess this is an example to read all of the ad and notice things like call for a price and no mention of in stock now etc.

About 20 years ago, I worked for Autotrader - way before there was a website of course.

But I remember that individual ads weren't always removed when they were scheduled to come down.  I sold the "display" ads to dealers - the ones that took up a full page in the weekly publications.  Those did come out when they were supposed to, and were updated regularly.

In many cases, the dealers would add single vehicles to their display ads, and often in multiple publications in different markets.

It wouldn't have been practical for them to check each one every time and many ran beyond when they should have.

Not saying that was the case here, but the dealer might have run it as a legit listing weeks or even months ago and never knew it was still on the website.

It's all about generating interest and leads.  Not Faulse at all.  The state call for price and don't swtate the vehicle is in stock.  Many dealers are taking orders.  As you know business is tuff and this ia a practise many retails utilize, not just car or motorcycles.

It's advertising, but I seriously doubt it falls under the definition of false advertising.  If you look at the ad, they list all sorts of other models as well, and none are shown as being actual in-stock bikes.  So what is Cycle Trader's policy on ads?  If they are only supposed to accept ads for individual existing bikes, then this ad wouldn't fit that requirement.  But I think you will find that there is no such requirement.  Cycle Trader is like any other such operation, they'll take any ad that's accompanied by the fee.  Kind of like Craig's List, where any kind of immoral or illegal activity can be advertised as long as the Craig's List folks get their fee.
