Beware: Inferno 2010 FLSTSE in Branson MO

If you see a 2010 inferno FLSTSE for sale in Branson Missouri beware, i won it on Ebay and i live in Australia after giving him $1000 deposit by paypal and asking for the lien holder details to pay out the balance he was stalling me and then tells me he was offered $2000 more and sold it.
He wont return my deposit because his brother the ebay account holder told me he is a Law officer and its a civil mater at best,i need to fly to USA to fight it and that i took more than a week to complete the transaction

You are protected thru paypal. Start a dispute with them. They will contact the seller and if they find him in the wrong they will charge his account the 1000.00 and return it to you. Good luck.

Hi,
i am not protected through paypal because its a deposit and the transaction was not completed and its not a tangible item, ebay says its not covered either because the transaction is incomplete also

This doesn't make any sense to me whatsoever!!

If you place a good faith deposit and the buyer backs out of the transaction for any reason you are entitled to a full refund.  Otherwise people would start using eBay and Paypal to scam deposits from transactions all the time.

I would waste no time contacting the FBI and other agencies. 

I would also resubmit my claim in writing with eBay and Paypal and attach your written complaint letter to the US Federal agencies. That may give them the incentive to get your money. 

Other issues:

The correspondance you received from eBay seems to be weak grammatically.  Are you positive that they sent you the replies?

To be sure, I would also, call the complaint in using the eBay and Paypal contact numbers from their site to confirm. You should reference the complaint number you should have been given.

Also consider that IF the brother is really a Police Officer he won't want you to file a complaint with his Police Department Internal Affairs Department. Especially if it turns out that he really isn't a police officer after all.

I hope you get your money back soon.

eBay and Paypal have changed their policies somehow.  Between three and four years ago I sold a bike on eBay with a $500 deposit set up just as this one was.  The guy paid the deposit then bailed on the purchase after I trailered the bike 600 miles to his front door.

If for no other reason than to cover the cost of transportation I refused to refund the deposit.  The guy filed a Paypal claim and got it back.

They may have changed their rules.  But the mails above seem not to pass the sniff test.

Moral support is all well and good.  But there's no way any third party has any impact on Paypal refunding the guy's deposit.  If cheerleading helps I'll wear the uniform.  But all the rah rah will only make us feel good.  The guy just needs to go through all the steps available to him.  Here's my good wishes that it works out for him.

I'd say we are doing more than just moral support...

Getting the info out there that this seller is one to be wary of (once we find out who he is, contact info, etc) we simply plaster it all over the internet for the world to read.

I go through great pains to assure I NEVER short change anyone. I as a buyer expect the same. That does not always happen as I found out from a set of wheels I bought... but whats done is done...  however, in this case, this jackwad took a guys deposit then sold the item to someone else for more. (allegedly) LEts find out and see where it leads...

This makes no sense at all.  "Non refundable deposits" are for the protection of the seller if the buyer backs out - not for the protection of the seller if the seller backs out.  Of course, I'm sure EBAY understands this distinction also...  Short of the OP supplying a few more details, this all seems a bit suspect.

If this is all for real, I'd consider contacting an attorney in Branson ... Even if the attorney cost a thousand, it would be worth it to me...

Just spent a few minutes doing completed auction searches at eBay.  The completed auction search tool doesn't search back an extended time.  Looks like about a month.  But during the time frame the utility reaches didn't find this listing.  In fact didn't find any 2010 Harley of any kind sold within 50 miles of Branson.  A Craigslist search for the areas of Springfield and Branson, MO and the adjacent areas in northern Arkansas didn't find it either.  The gentleman will need to provide specific listing information to know who the seller is so he might be avoided.

I LOOKED AT THE Ebay policy and I think they have committed fraud in not delivering the bike?  Please refer to The verbage about 7 paragraphs down.

Now that would definitely end a police officers career!!

I would hope that no one on this forum would do anything that could be considered problematic.   :rifle: I like anyone else just wants to be able to get enough facts so that properly informed "we" can give him a knowledgable answer that helps him recover his deposit or at least prevent this EBay scammer from ripping off another victim. Never intended to take vigilantly matters in my own hands.  :knife: :behead: :hanged: :beatdeadhorse:

Hi every one,

Thanks all so much, i have called both ebay and paypal both in Australia and the USA to no avail, he now just sent an email offering $500 back only

He is telling ebay because i didnt complete the transaction within 7 days i broke the policy, its true i didnt but he took a while to give me the details and then i had to make many calls to the bank to get the correct swiftcode and details to try transfer the money, the problem was he owed $21200 to harley finance and it was harley finance i had to pay.
now the tricky part was when i tried to wire the money i was sending to New york melon bank to harley finance and there was no provision to add a another third party and the bank told me it was risky so i called him and explained that i may need his personal account to transfer to where it would be easier but i would send $50 or a small amout just to make sure it went though and he received the email receipt from my bank.
i kept calling him asking if it went through (he would never call just email) theb when i got his personal account details he told me he had others interested in it, i will attach an email back and forth from him

The brother is a liar saying i didnt have the money and had to borrow it and i couldnt complete the transaction, i did have to borrow it from a friend but i explained that to them before i bid in a phone call and the money was ready to go before auction ended

I can tell you first hand that transactions between Australia and the US are NOT easy to accomplish. There are differences in the currancy exchange rates for each country, bank account and bank routing numbers unique to these type of transactions and of course a international payment entity called SWIFT. We both tore our hair out trying to make things work using the same payment systems which as in this transaction finally worked out just NOT in the timeframes we wanted.

SO with all of this in mind, I would hope that the sellers would realize that;
1. They got what they wanted for their motorcycle from someone else.
2. They shouldn't profit from a deposit on a transaction that they didn't complete despite the best efforts of BOTH the buyer and seller.

I stand by my initial recommendation. I would now definitely involve the Branson, MO Police Department Internal Affairs Department if I wasn't made whole and received my $1,000 back ASAP!

Seeing as how the Branson PDs seem to have a "small town PD reputation" you may want to take that inquiry one step further and go the the State Police agency that oversees the Branson PD.

Well he might want to receive lots of mail over there. Since he's a sworn officer of the law he might just want to use common sense and logic and return all of the money once he understands how the international payment systems work.

If the charge was made to a Visa credit card you've got that as a potential and even likely solution.  Just have the credit card company do a chargeback.  It's out of Paypal's hands at that point. 

For what it's worth it'll still end up costing the seller.  If your credit card handler charges back against Paypal Paypal will then charge back against the seller.  Been there and done that.

This sounds like it needs to be reported to the U.S. FBI internet fraud division. Maybe internet inter-continental fraud is a crime they would be interested in hearing about.

I have sent an email to the Investigations Captain at the Branson MO PD ... surprise no reply
I have save sent email's to his local newspapers ... no reply
I also filled out the form for internet crimes on  http://www.ic3.gov , no reply from there either as yet
The good news is Visa reversed the transaction to paypal, paypal have since limited my account and have phoned the seller and are "building a case" to fight against the reversal. Funny how paypal are not interested in reading our email where he says he is selling it for more else where and in another where i have asked for my deposit back (on phone and email) he says he would refund it then says "it wont let him do it that way since the money is withdrawn ... maybe he can send it some other way"

Almost a year ago i  bought a blue FLSTSE from a gentleman in Farmington NM and everything worked out great we still keep in contact. Its people like Officer H that that makes you want to never trade with anyone abroad and being a police officer makes it all the more shameful

And if Paypal gets pissy about being cost the price of the chargeback the worst they can do is close your paypal account.  So you use a different email address and a different funding credit card and make a new one.

Don't let people pay you at that account anymore.  What's in there they will very likely eventually keep in their attempt to recover what the credit card company charged back against them.  Needed to clear your Paypal account before doing the chargeback.  Definitely don't let any other deposits go to that address/account.

...on a side note multiple accounts isn't a bad idea. This past year Paypal starting sending a version of a 1099 out for more than 200 transactions or over 20K. The numbers are gross numbers as they neglect to deduct their fees from that number. Anyway just a heads up as I received mine and initially fell out of my chair!

Bastids.... that was my "Play" money account. Reporting it takes all of the fun away from it. I purchased my Buell 1125 using my Paypal account and after that went big and bought a Corvette about a year and a half ago with it.

Nick...good luck getting through this.  It's obvious someone came along after you gave him a deposit in good faith and offered more.  It doesn't make sense PayPal won't read the Email string.  Heck, I'd send it to them anyhow.  It would make it clear you were trying in good faith to get the money to him. 

The seller backed out and is using a technicality to take your money.  If he'd not heard from you and had not been trying to work out the transfer of funds, it would be different.  It's not like you were dogging him and leading him on.  He was wrong for doing you this way.  Sorry brother. 

Consequently, this is why I restrict my sales to domestic and avoid international deals.  Nothing bad on you, it's just too many things can go wrong.  With a respected member of the CVO Harley group I might make an exception, but on Ebay...no way.

Hope you get your money back friend.

Nick...good luck getting through this.  It's obvious someone came along after you gave him a deposit in good faith and offered more.  It doesn't make sense PayPal won't read the Email string.  Heck, I'd send it to them anyhow.  It would make it clear you were trying in good faith to get the money to him. 

The seller backed out and is using a technicality to take your money.  If he'd not heard from you and had not been trying to work out the transfer of funds, it would be different.  It's not like you were dogging him and leading him on.  He was wrong for doing you this way.  Sorry brother. 

Consequently, this is why I restrict my sales to domestic and avoid international deals.  Nothing bad on you, it's just too many things can go wrong.  With a respected member of the CVO Harley group I might make an exception, but on Ebay...no way.

Hope you get your money back friend. 



Personally I try to accomodate everyone... most international buyers know the shipping is going to be excessive.

From my experience, the transaction seems to take longer... but I'm used to that living in Hawaii...

As long as both of you are good on your word... thats all that really matters in the end... Officer H on the other hand I wouldnt trust with a 10 foot pole.

...on a side note multiple accounts isn't a bad idea. This past year Paypal starting sending a version of a 1099 out for more than 200 transactions or over 20K. The numbers are gross numbers as they neglect to deduct their fees from that number. Anyway just a heads up as I received mine and initially fell out of my chair!

The regulation actually states "more than 200 transactions AND greater than $20,000".  It excludes any "garage sale" type transactions.  The intent is to require high-volume sellers to report their earnings as income from a business, as they should have been doing all along.  

Bush signed this back in 2008 and it's finally taken effect for the 2011 calendar year.
