I understand your frustration JoMo about the driver being released. My guess would be that they will charge him once the blood test and autopsy results are sent to the police and state's attorney for review.
I know on cases like that the prosecution needs to cross their t's and dot their I's to get the probable cause to charge  for manslaughter and they would hate to see anything get dismissed for a technicality.

Similar case in Houston.  Drunk ran a red light, hit a SUV, killed three young girls.  Failed sobriety tests at the seen.  Cops let him go pending blood test results...P.O.S. jumped on a plane later that morning to Nepal.  More than likely will never be seen again!! :sauer005:

It was just reported that the guy's BAC was 4.5 times the legal limit at 0.373.

if the cager was drunk, get a rope, but on the other hand i'm thinking the bikes were way too close to each other since all four were taken out by one vehicle.
i don't like to ride too close to any vehicle and never ride abreast of another bike.
time and distance are your friends.

I don't think it would've mattered if they were single file. An ONCOMING truck took them out. That would be very hard to avoid unless they were able to see him a 1/4 mile away first. Head-on collisions are usually the fault of the person who crossed over to the other lane, not the people driving/riding correctly...

The Key word is "times". 4.5 times or 4 1/2 times .08 = .36 and his was .373

he was stinking drunk......

This happened on I-29.  This was a construction zone, where both directions of traffic were driving on the same side of the interstate.  Wife and I were headed the opposite direction of the 4 killed.  There was nothing they could do on those bikes.  Traffic was very heavy in both directions and the truck just crossed the line.  We were about 3/4 to 1 mile behind the truck.

The truck driver needs to be in prison for the rest of his life.

I do not see how any one can put any blame on the four bikers, even if they were driving in very tight formation.

i was not trying to cast any blame on the bikers,the truck driver was drunk and over the center line, his fault totaly.
 i was just wondering how all four bikes were involved in a headon wreck. i was only trying to state that riding in a group requires more caution versus riding alone.
i still maintain time and distance are on your side.
