Plaintiff claims the brakes locked, causing the trike to swerve into the opposite lane, go off the road, and down an embankment, killing a passenger.

Have a buddy that said his brakes have done that 2 times at low speeds and each time HD tells him it must have been something he did they can’t get it to happen, basically saying it’s not the bike the but rider.

It can and has happened.  H-D had a recall for 2019 and 2020 models for a software update to address this problem with the traction control system.  Basically under certain circumstances it misinterpreted speed sensor input mistakenly thinking one of the rear wheels had lost traction and applying the brakes on that wheel only to correct a nonexistent condition.  Scary stuff for sure.
