Freedom Harley Davidson in Lakewood Colorado is the dealer that threw me under the bus. They said they didn't want to effect my warranty. But they put right on the warranty work order that I had the TMax ECM and that they could not hook up to it.

Have you contacted ThunderMax for their opinion? I don't think a different ECM would be a problem as long as it worked before.

Modifying the stock ECM is one thing, but replacing it entirely really does open the door for the MOCO to mess with the owner when warranty work has to be done, or if you break down on the road somewhere away from home and they can't hook up to diagnose whatever problem.  It just gives them a really good excuse.  Of course, saying something totally unrelated to the ECM is not warrantied because you've changed to a third party vendor is absurd, but they'll use whatever excuse they can at times, and some dealers are known for their absurdity.  I had to get a new FOB paired up a few months ago...just to be sure there were no issues, I downloaded the original program into the ECM rather than the one modified by the TTS Mastertune before I took it in.  I'd just rather not argue with them about BS.

And the M-M Act is only good IF you've got enough coin to argue against whatever factory is denying your warranty.  They can always deny the warranty and it's up to you to prove the offending part didn't cause the issue.  It's a great idea, just no real way to make it work.

Actually that's not the way the law is written.  Supposedly they have to prove your modification was the proximate cause of the failure; the customer doesn't have to prove squat.  However, in the real world it's never as simple as that.  Sometimes just having an attorney send a letter to the right person will be all that's needed.  Other times it might take actually going to court.  At some point it may be necessary to weigh the cost versus benefit and throw in the towel.  But to just surrender without firing a single shot is exactly what the crooks want you to do.  If anyone wants to cave to intimidation without even a whimper, it's none of my business.  But if they do, they don't need to look for sympathy from me.  The reason these places continue to get away with this sort of BS is that no one steps up and busts their ass.

Dealers and the moco try it (and seem to get away with it quite a lot) because people don't know about the law.

So which one of us has the money to step up and do it???????   While the law was originally intended to protect the consumer, it's not the case anymore.  If it were, we wouldn't be having this discussion because the OP wouldn't have had an issue.

In this day and age of the "United State of Lawyers", you do have to prove innocence not guilt.

I call BS!  I had the T-max TBW tuner on my 2012 FHLTCUSE and I never had any issues with the heated grips, electric locks, heated seats, nothing!  Go to a different dealer!
