Is There a Class Action Coming?
« on: September 20, 2007, 11:24:21 AM »

I just saw this on another forum. It's from an old member to CVOHarley

Quote
Just for your information, a group of attorneys are looking into
possibility of filing a law suit against Harley related to the 110
inch motor problems. I am a past owner of one these POS and was
contacted by a paralegal and answered a few questions regarding my
experience. They picked up my info from another web forum. I suspect
this is going to gain mometum and we are going to be hearing a lot
about these issues in the public forum.

My 07 CVO had one motor swap and spent more time in the shop then
under my rear.

Has ayone else out there been contacted??

Evil

Has anyone here been contacted? I haven't.

From the little I know of class action lawsuits, the attorney's make all of the money.

That's very true. I see this as just another way to express a combined dissatisfaction with the 110's. It doesn't currently appear that they are paying a lot of attention to the problems so many are experiencing with the 110's. Maybe if this is true, it will encourage HD to look at the problems a bit harder.  :nixweiss:

For what it's worth...
I was a party in a Class Action suit that involved 2000+ claims against 5 Rubber Companies that resulted in a $27 Million settlement ( I got about $2,700 )
The Attornies got roughly 1/3
It was at that time the largest EPA class action on record

And maybe actually fix the problem.  That's all I want.

I have sought legal counsel in reference to the 110" issues.  Yes, typically the attorneys make all the money; however, we are talking about our safety and lives on these machines.

I should know more next week; however, this endeavor will be very VERY expensive and I don't know if I can sustain the financial burden...

Look there is already a complaint on file with the NHTSA: http://www-odi.nhtsa.dot.gov/cars/problems/complain/results.cfm

I would encourage *all* CVO owners whom had an issue to register their complaint via telephone or online.  With enough complaints they can take action, if MoCo will not voluntarily recall the engines the NHTSA will make them recall the engines!

"Government engineers analyze the problem. If warranted, the manufacturer is asked to conduct a recall. If the manufacturer does not initiate a recall, the government can order the manufacturer to initiate a recall."

Online: http://www-odi.nhtsa.dot.gov/ivoq/
Telephone: 1-888-327-4236

Actually there is more than one, you have to look separately under each model and model year.  This is one of them:
http://www-odi.nhtsa.dot.gov/cars/problems/complain/complaintsummary.cfm?odi_id=10198501&prod_id=218242&cmpt_id=127&type=1

And another:
http://www-odi.nhtsa.dot.gov/cars/problems/complain/complaintsummary.cfm?odi_id=10203375&prod_id=218245&cmpt_id=127&type=1

I have no idea what volume of complaints it would take to initiate an investigation, but I'd bet if you had 10 or 20 it would at least precipitate a letter or call to the MoCo.  Since we've already had one member we know of injured when his 110 locked up, this really is a safety issue.

I once got a check for 12 bucks over the chevy truck gas tank deal.  :nixweiss: I thought it was a waste of time. I even got a check for 3 cents over a insurance claim on a totaled bike?? I never cashed it and they worked me over good, it messes up there books as they keep sending a new one very few months.

HD did pay attention to the cam bearing issue so maybe this will make they look at the issues that the owners have
