Any movement has to be done in safety… she would be at fault because the action that she initiated resulted in a collision.

Regardless of charges laid, insurance companies will assign responsibility or fault.

Police can charge a person for making an unsafe lane change for example; placing the other driver at fault, and the insurance company will look at it and decide that the “victim” held some type of responsibility for the crash.

Why would you have to pay a deductable when it wasn’t your fault?

You should only pay a deductible if it was your fault, or if an act of nature causes the damage.

There is no way I would pay, and the parts would come from Harley… there could be all kinds of issues down the road with peeling etc.

If you do get stuck with a paint shop you can insist on a lifetime warranty.

Our civic got whacked a while back; we’ve had to send it back for peeling paint three times now!

did you take your car to where they wanted it fixed?  bad mistake... they recommend them for one reason they cheeper & cut deals to use aftermarket parts... but thats a whole other topic..

That's exactly what the adjuster told me.  He left about 1/2 ago.  Originally he wanted to have the fairing removed, buffed and clearcoated.  I told him the one small scratch is into the color and the price difference of replacing was only a couple hundred dollars.  He agreed and wrote me a quote for a replacement outer fairing.  He'll call me after getting the story and seeing the damage to the other vehicle.  I told her she came into me while trying to avoid another vehicle in her way while I was waiting to merge.  Either way, I'm out $500 for getting it fixed but the other carrier may reimburse my ins who will in turn reimburse me the portion they find the other driver at fault.  Thanks for the advice everyone it REALLY helped me in dealing with this incident.

You already have good advice here on repairs - very glad you & your daughter were not hurt.


Let's see.... I would sue the owner of the van, her husband, her parents, his parents, their kids, any future grandkids, the last road paver contractor, the road line painters, the surveyors, the community the road was in, the convention center, REO Speedwagon, the local weather forecasters, PETA, & of course, Global Warming.  There are some pretty good lawyers on tv that promise to fight for your rights & charge no fee unless they win & they seem real sincere & all.  Good luck!

   Glad the only damage was to the bike.If it was me I'd get the advice of a couple shops.If they make you feel warm & fuzzy about a good fix without removing the fairing get the $$$$ for a new one & fix the scratch.If you're not happy with the fix you can always have a new one put on.Haven't seen the damage,but some of these guys can work wonders.

From what I have been told, the clear coat is powder coated on and it would be hard to fix.

So I vote for having the fairing replaced.

I would prefer to sue al gore for creating it, from his own warped imagination, but he is so busy trying to convert water into gold by alchemy these days. Also not sure he is suable due to his Popeship over Climate Change & all.

Will withdraw suit remark on REO due to deciding to include "Take it on the Run" on my MP3.

FYI, CVO paint - at least fiberglas parts...maybe all by now - is done at H-D's Tomahawk, WI facility. I think it was Calibre Paint before Harley bought them out..?

I figure al gore is responsible for the leaking oil problem in the 110's even.  It's part of his dastardly plot to destroy all that is right with America.  I have tracked him back to the origins of the Heartbreak of Psoriasis even.   ;)

Thanks.  It's not such a big storm from wind damage & all & I try to go nuts & set my hair on fire & run amuck so I will fit in with some of the locals (usually the transplants) who live for crazied frenzied behaviors brought on by watching the Weather channel 24/7.  But it's just too much of a bother.  Sometimes we have a hurricane party.

aw come on now, its only with fellow (sort of) Floridians who regress and go from an awesome (albeit not GOLD) SERK to a FD...that is my hangup.

(Well I have others, but they are best not aired here - that thing with the poodle was a one time thing and I don't want to lose my clearance).
