The IRS and the common Citizen
« on: August 22, 2008, 02:42:59 AM »

Well Bro's, I had a my bad and didn't know it.
To make a long story short;
Since 1985, I had the opportunity to retire early due to a irrevocable and non-ownership Trust. I wasn't aware of filing Tax Returns or how to handle such a situation. I thought I was OK until July 16, 2008. IRS had Levied against my bank account. All monies that I had every had was removed. The amount was $2,341.05.
When I investigated the situation, I found out by the USCode Title 26 that I was Levied against by the IRS with Title 26, Subtitle F, Chapter 64, Subchapter D, Part II, Sec 6331. They did not bother to use Sec 6330 which would give the Citizen a chance to work it out.
Further investigation came up with that two fraudulent 1040's had been filed thus creating a owing situation with the IRS. I state fraudulent because I didn't work those two years, in fact, the years filed were 9 an 11 years after I had discontinued work.

But this is not the most disheartening situation.
I had located the necessary information, and shot an email to "Office of Professional Responsibility" on the "Improper use of Title 26" against the named IRS agent of the Levy.  They in turn forward the information to "Treasury Inspector General for Tax Administration (TIGTA)". Now the fun begins.
Since emails began, I have had 1 IRS Revenue Officer and 2 TIGTA Special Agents at my residence doorstep.
Somewhere, before the first email to OPR, I had put in place some Tax Professionals to run interference and straighten this mess out.  The atmosphere of emergency could not match what has transpired in the last 3 days.

I bring this tale of woe to my Bro's for a couple of reasons,
One) Our US Government hasn't any respect for its' citizens when it comes to the Treasury Department.
Two) If you have a legal grievance with these people, be ready to walk a line that is a micro meter wide. They will use that kind of heavy handedness. Know the USCode Title 26 and Title 26 Appendix.
Three) Don't count on anyone unless you paid for their services. I think you can include Senators and Congressmen.  They don't respond very quickly to issues.

My situation will be ongoing for awhile. And if I am around to add to this thread, I will update it.

George, what a mess.  Sounds like you need to get a job to pay for some good representation.  Shame it comes to that.  Good on ya.

Sorry that this has happened to you.

Brian could tell you some stories about the dealings he has had with the IRS as well as with the State treasury department.

Tell Brian at the next Gathering, MV08, he and I could swap the horror stories.
If I survive this, Judy and I would be glad to see Brian and you.
Thanks for the uplift, this is terrible. So far it's been quiet as to the Treasury Department, maybe Tax Masters are doing their paid job.  I haven't heard a peep from my local State Senator, go figure.

Hey Mike,
You are right they are very confident that they can do anything.  But even they have to follow rules and codes. Or it's their bad. And it would reflect how our U. S. Government respects its Citizens.
But Thanks for the uplift.

Update

I have put an inquiry out to the Tonight Show with Jay Leno to see if there is any interest.
I am going to expose this for what it's worth. :nervous:

Do you have a local "News Power" investigational TV reporter?

I have to agree, I read his home page.  The guy makes $20 mil/yr. Small pennies, doesn't mean anything.

Good suggestion on "News Power" investigational TV reporter, should this situation turn "hot and heavy" again,
you betcha it will be in the news. Thanks.  :2vrolijk_21:

Good suggestion, I haven't looked there yet. She backs Obama. :2vrolijk_21:

Update:
This idea gave way to a better idea. Both Obama's and McCain camps (websites) have been quiried with this very question of the IRS.  Let's see what happens. :2vrolijk_21:
