OUT OF POCKET EXPENCE?

I talked to law firm today and said that tune up was a expence on my 07 that was recomendedto help cool motors heat problem. They said it sounded like out of pocket. ride safe jdo

For those who didn't follow this, it's about the class action lawsuit over the 110 engine issues for owners of '07 & '08 models.  For some reason, the attorney's involved have told at least a few people that they can get reimbursed for their expenses for "tuning".  I tend to wonder if those attorney's are the least bit familiar with the EPA, or with the fact that retuning for a richer mixture will result in excessive emissions and constitute a violation of the law.  Probably not.

Jerry, I think the wording was for expense related to: "documented out-of-pocket costs incurred in attempting to repair or address the " problem.
I'd have to agree that any modification not adhering to federal regulations would be ill advised.

I also agree that the wording in the proposed settlement is as you stated.  But when people call and talk to one of the attorneys, more than one has indicated that they were told they could also be reimbursed for the tuning costs (SEST, dyno tune, etc) to reduce operating temperatures.  That's what makes me believe that these lawyers know not of what they speak.  Asking H-D to pay for emission system tampering, which will place them at risk for massive fines from EPA, isn't something I can see any competent H-D attorney approving.  Of course, that assumes their attorneys are any more competent than the engineers and management folks who unleashed the sorry mess on consumers in the first place.

I hope everyone affected gets everything coming to them and more.  I just don't want people to go into this thinking they're going to make a killing.  The only ones making a killing on these kinds of deals are the attorneys.

Well I think it is a class action lawsuit (maybe it has not yet been filed, don't know for sure) but what is being proposed is a settlement offer to avoid the time and expense of going to court.  And it is only proposed, H-D has not agreed as I understand it.  FWIW I doubt I'll get much of anything because all of the repairs were done under warranty.  I spoke to the attorneys and there is nothing for loss of use (mine was out of commission several times totaling over 60 days the first 9 months I owned it).  And when my engine crapped out on me I had to get home, borrow a trailer and go to the time and expense of driving several hundred miles to retrieve it and bring it to my dealer for repair.  Again, no reimbursement for this cost.  And no compensation for loss in value of the vehicle due to the myriad of problems.  Only other out of pocket I had was for SERT, exhaust and tuning in an effort to cool it down and I doubt that will fly.  So WTF is in it for me or most of us?  Not much as I see it.  Like Jerry (grc) said, the only ones making out here are the attorneys, surprise, surprise.

That is correct - proposal will pay for 2 years of ESP but at a rate reflecting the moco's cost.  Bet that will be a lot less that what we paid!

They will give you two years of warranty if you have none. If you have extended they give you "up to" $700. (If they give you rate of warranty based on their cost, that would be closer to $350). So in fact you really get nothing but screwed again. $350 will by you a nice overpriced leather jacket. The breakdowns, other than leaking gaskets are major when it comes to 110's. I just had cams replaced at less than 4000 miles. 2007 $26,000 new, $17,000 today if I screwed someone into buying it. All I want is a bike I can ride.......Without worrying about getting stranded on........again.
