I'm going to try and get a better pic taken and posted today. Pretty sure my boot is not touching heat shield. It feels really rough and pitted when you touch it. Thanks      ****Update Below*****
Jerry did just as you suggested. Rolled bike out of garage, used a little Windex, then used a little Mothers Chrome Polish, then took some pics. Did not come off, not boot marks. Rode to stealer asked new Service Manager if he would look at shield. When I asked he said MoCo did give dealers "Goodwill" money but theres was in limbo due to being messed up by previous management. He was "generous" enough to give me direct HD customer service phone number because they responded better if I call and tell them my problem instead of him. He said "hey all they can say is NO or they may tell me to correct it.  :nixweiss: I asked if could they not replace it with one that had been removed from another bike, he said they didn't have any now but would keep and eye open for a shield and would "SELL IT" to me for a good price. The good part of the story is one of our great forum members I was chatting with last night said he thinks he has an extra shield that he will...wait for it..."Give me." And I got to ride today!
4/23/11 **** UPDATE**** I WILL GIVE CREDIT WHERE CREDIT IS DUE!!!!!
The other week when I spoke with the new Service Manager about the heat shield I was really wanting to talk to the new General Manager but he was not working that day. My wife was wanting to ride somewhere today...so I thought since the local HD had just been remodeled on the inside and she had not seen it that would be a good place to start the ride. I just finished my FREE chili dog, was ready to leave, wife said was going to restroom and would meet me outside. As I was walking by the front desk the GM was standing there and said hello, (I thought I will ask him) I shook his hand and told him my name. He looked at the shield and said we have one in the back that you can have and I said thanks that would be great. SO new management came thru, don't know how they will be on high dollar items but I got a new take off heat shield.

Easy way to tell, get a little chrome polish and lightly polish the area.  If it's just stuff transfered to the pipe by rubbing on your boot or pant leg, it will come off.  If it's lousy plating, it won't.
