Could be a lot of things, but considering all the problems people have had with 2008-2009 Touring models with electronic throttle control, I think I'd start looking at electrical connections.  Harley has a known product problem with fretting and corrosion of terminals in the various connections related to the electronic throttle control.  Often those problems cause the bike to go into limp mode, but they could also affect cruise control.

Glance through the attached document for some insight.

I had much the same problem on my 2010 EG Ultra and when the stealer got done with it they said it was the rear brake switch, not the one that controls the brake light but the other contact in the switch. I had it replaced under warranty and the next week the switch recall came out and I had it replaced again with the new model. One of the requirements for the cruise to work is no brake is applied. Even though my brake lights worked fine, the switch was showing brakes applied and the cruise would not engage.

Even I did experience the similar in mine. Are you able to find solution for this problem?
