WV....yes, I believe it is, though I am not 100% certain about this. In order to get the regular round K&N to fit decently, the thick gasket is required between the cover and the filter. Not because of the seal, as the filter fits the baseplate just fine (the SE chrome baseplate), but the cover is made in such a way that there is a gap where the top of the filter meets the CVO football shaped cover on the Ultras. The thick gasket helps fill those voids.
Although I did not actually fit the filter of the 3910 kit inside the cover, it appeared that it would work. I wish now that I had looked into it a little deeper. 
When I was doing my own SE on the 07, I was trying to come up with a slick way to fix the cover issue and wasn't being very successful, then a bud of mine who was over checking out what I was doing asked me "Why don't you just put a thick washer under the bolt to take up the space?"
It works great.
