In Florida it is up to the lien holder, we even have an option of having only an electronic copy of a title if it has a lien. The lien application form has a check area for owner holds title or lien holder holds title.

AZ just started in 2005 with the lien holder maintaining the title when you purchase anything that has one.

Prior to 2005, AZ was a "non-Title" state.  It is possible you have a document that looks like a title but if there is a lien, you need the "release of lien" from the "lienholder" (Bank etc) to process the title work.  After 2005, the various lienholders in Arizona can decide if they want a paper title (extra cost to them for someone to handle and file) or they can go with a "paperless title".  In all situations, there has to be a release of lien to effect a transfer in legal owner.  If no lien holder then you are both the legal and registered owner.

We're having difficulty getting the final registration sticker for my wife's sporty because the bike has been owned by two women previously who both had satisfied liens against the title (which we have) but the dealer gave us the lien release from the 1st owner instead of the 2nd when we took ownership.  The DMV caught it and sent the paperwork back to the dealer instead of calling them to have them fax it.
