I might be missing something here, but after reading this,

the drunk ran into a car putting it over the median strip disabled and  that driver gets out and goes back to the center for safety

and a motorcyclist comes down the road minutes later and hits a disabled car on the freeway.

I am not defending the drunk . but it would seem to me that the motorcyclist has some responsibility to bear.

Am I wrong here?

Yes, you are wrong.  Maybe you should gather all the facts first.  There is more to this than some stupid motorcyclist hitting a stopped vehicle in the middle of the road.

All I did was read the article. I know that the press does not always get it right,  but what info do you have?

2.  Friedlander loses control and her car goes over the center divider and is disabled in the northbound lane
3.  Friedlander gets out of her car and runs into the center median

she was sentenced to 9 years for causing the crash

so since we are not clairvoyant and can only go with the facts as they are presented, what knowledge do you possess that we are missing?

Poorly written article (seems to be the norm these days, journalism is a nearly dead profession), so we don't know what time of day (day, nighttime darkness,?), weather conditions, traffic conditions, etc., so it's impossible to assume the bike rider could have seen and avoided a wrecked car sitting on the road.  What we do know however is the drunken driver caused the crash that ultimately put that wrecked car in his path.  Without her, he would still be alive.  Period.

I looked at several articles and the time of day and it was night 11:33 PM, so darkness probably paid some factor.
The weather in Santa Ana in March probably did not factor in, since there is hardly ever bad weather.  
The 405 certainly had some factor, since it is a heavily traveled dangerous road.  

but consistently it was reported that the cyclist hit 2 min after the initial crash.    Not sure what was going on and certainly a tragedy for all involved.

I was only pointing out that something did not reconcile in my head about the article,  
but was taken back by the tone of dLaws01  chastising me for not knowing the facts.....

still waiting for a correction or explanation

I have been away from this board for a while and do not know all the players anymore.

i agree completely.  i have no idea, nor any assumption about the bike rider being able to avoid the disabled vehicle.  i don't even know the road.  hell, for all i know, it was right on the exit apex of a curve.....

as a professional o-t-r driver for 39 yrs. I'veseen this over & over in the trucking industry. If the driver had stopped for a safety inspection, or had taken longer a pre trip, he wouldn't have been there when my client ran the red light, stop sign, etc. so they come after the trucking industry. without knowing all the circumstances it's hard to pass judgement. would like to think that mc still could have avoided the accident, if he was paying attention, looking ahead. Don't know where speed & weather (rain, fog, visibility) come into play. with all said, it's still a tragedy that I hate to hear about. even more so when you do hear that alcohol is involved to some extent.
