So....I got my replacement heat shield for my Vance and Hines Power Duals and I also had the back floorboard support replaced too.  Everything is as it should be.....and have been the first time.

The problem:

Vance and Hines obviously makes their products based on the standard Harleys.

The CVO Harleys have thicker, different floorboard mounts and Vance and Hines makes no mention that an additional spacer kit is needed to make everything fit properly.

The kit needed is Vance and Hines part #: 16937  It is around $30 shipped.

If you are going to add any aftermarket exhaust, purchase this kit.  I had to have the front heat shield replaced and the rear floorboard support arm replaced as well because the two were making contact.

I hope this helps anyone in the future!

Hmm. That has me wondering if Steve at Fullsac makes a different pipe for CVO and Non-CVO's then. I put his stainless DX pipe on mine and it fits perfect, and went into the heads just like OEM. He must have had to spend a lot of time getting the bends to match exactly. Mine does not hit anywhere and uses the stock shields.

This is for aftermarket systems that don't use the factory heat shields.

Nicky, V&H has had that problem for ages, and it's not because of a Harley floorboard mount, it's because of the way their pipes are bent and the way their heat shields are made.  I had to add a spacer to my floor board mount on a 2005 model when fitting V&H pipes years ago.  At that time they actually included a thick washer to be used to shim the floorboard out slightly.  If they have stopped providing or mentioning the spacer in the instructions, they really shouldn't have.  It's a good thing you brought this up, because many people in the past thought they had a serious engine problem or went nuts trying to locate the noise and vibration the contact with the floorboard created.

They still come with the spacer and thick washer. This kit is 3 times thicker than that washer and spacer, and replaces them. The correct fix would be for V&H to make a different front heat shield for the CVO's that follows the angle of the floorboard mounts. I ground mine down to have even spacing and put this kit on.

Mine is all good with the spacers now.  I'm amazed at the quality of the chrome on the  Vance and Hines heat shields.   The floorboard arm was bouncing off of them for 100 miles and the  probably didn't even chip, it only dented!

Here is a pic of the problem.

The angle of the hole is wrong for the CVO back floorboard arm.

These are pics with the 1/2" spacers on to give about a little less then 1/2" of spacer between the arm and heat shield.

The brake lever is fine.

This is the kit. They do not come with this. They come with a thick washer for the front arm, and a black spacer for the rear arm of the floorboard. I've mounted 4 sets of power duals. This is the first to have this problem.

If you look at the standard touring bike floor board arm, the slot it cut perfect for them.  All Vance and Hines should do is a disclaimer.  "If this kit is being used on a CVO Touring Model 2009 or newer, you need to purchase our floorboard spacer kit, part number 16937, for additional clearance needed for the rear passenger floorboard support to not make contact with the front heat shield."

The Kury Crusher powercell pipe, made by V&H for Kury, comes with the PROPER spacers, for a no interference fit anywhere. They also have 18 mm O2 bungs, as well as the Lambda bungs.
Best dual system I've found.  ;)
