It is my understanding that the EPA certification of a “package” does not accommodate any flexibility.
Consider that in 2001 the SERG was EPA compliant, yet at that time the same engine package (1550 stage 2) installed in any other model was not.
These early stage 2 applications were later certified; I don’t recall the year; ’04 maybe?
It is my sense that it is not possible for a SERT equipped package to be certified because it is not “tamper resistant”. Currently all compliant packages come with an ECM reflash instead of a SERT.

My point exactly! My Dealer told me that he could not touch mine. Without affecting the warranty!!! He suggested to ride it stock until the factory warranty
Expired. He had a few bikes that the Moco DENIED warranty work on due there
being a SERT on the Bikes!!!
It is possible for the Dealer to cover the work, And eat the parts and labor since they are Independent. But ask them to put it in writing and see what they say! It says right on the SERT " For RACING ONLY"
I think my Dealer does not like it either, But he is just trying to be straight with me. Another dealer told me that , Sure we can put pipes, SERT, AC on your bike! But , We warrant the work of the mechanic only!!! After a lengthy conversation, He told me that you have to sign the invoice which states, " you requested this work to be done, and you are responsible for any Ramifications thereafter." ( In so many words) I am sure it is worded different.
Anyway, I think these dealers are Blowing smoke , just to get the sales, and installs on these bikes that have SERT, True Duals, ETC. And I am talking about the FLHTCUSE2, Because in the 07 catalog they do not even offer a Slip on Muffler for this bike.
One member even posted that his dealer wanted his bike to be STOCK when the MoCo rep looked at it for a warranty issue.
My dealer says that 07 is the drawing line for the MoCO on EPA,MODS,SERT, Etc.
I know a Dude real well who has bought a 07 CUSE2 who is going to Install a Zippers TM, and Slip ons , And AC Himself. And if he has any major Warranty issues??? He will
put the factory ECM, Pipes and AC back on before taking it to his dealer for warranty work! If it happens on the road, he will trailer it home, and do the same.
BTW, this Dudes bike was made in January of 07. And run in stock configuration for
150 miles. And he checked the plugs to find. They were Black! The rear was almost moist! So they have added fuel to the latter build dates of these bikes! Just as someone else here has posted.
