110" fried at 812 miles, bike trashed.

Got the bike out this morning... sunny and 78. Rode for about an hour between 45 and 55 mph. on some back roads. I slowed down to 25 in a small village and continued my way through. As I started to get back up to speed, I hit around 2950 RPM and the motor siezed. This caused the rear tire to lock up and I lost control and dumped the bike. I'm fine, just a few cuts and scrapes and a broken finger.

I got it towed to the dealership and went home. They called me about 30 minutes ago and told me the rear jug got too hot and scorched the cylinder walls. This caused the piston to lock up. I was told that the mixture was too lean and that was caused by several WOT attempts. It will not be covered under warrantee. The tank smashed, the pipes are flat, triple-tree broken and a front spoke broken.

I never have "attempted" a WOT due to it being in the break-in stage. It's automatically my fault. I'm sick of being treated like this. I give up.

Sorry to hear of your accident and glad to hear you weren't hurt that bad.

Concerning your bike I remember you having issues in this thread - HELP! 110" with fuel smell in the oil. I'm not as technical/mechanical as some on this board, but it would seem to me if you were smelling this and it was the case then it could have been a contributing factor to your rear jug seizing. I would remind the dealer of this, contact MoCo customer service, and possible contact a lawyer. Seems to me they could owe you a lot more then fixing/replacing your bike. :nixweiss: Good luck, and let us know how it goes.

sorry to hear about your bike, but very glad to hear that you're okay.  The bike can be replaced.  Don't let it rest...like d00d said talk to the MoCo and be prepared to put a lawyer on retainer...sounds like you've got a good case here.

Glad you made it out in good shape from the mishap.

I would think they are talking a good story but can't imagine they are going to be able to make that stick.  Can they tell when the WOT attempts were made?  What does it take for one to register? 

Hell, who cares, I can't imagine this crap.  We all know those motors are lean as hell and get hot as haddies too.

I haven't read the 07 manual, is there some big warning about WOT may cause injury or death and voids all warranty?

Glad to hear that you are not hurt seriously, though any hurt at all is not a good thing.

I read all your questions/concerns about the fuel smell in the oil, and you taking it to the dealer to have them access the situation.  You have that on record, I assume?  Even if you don't, how the F does the dealer know if you did a WOT?  Turning the ignition on and twisting the throttle does not count.

Sounds like your dealer is in the cover his ass mode.  NO bike, if it was delivered with oil in the crankcase, should seize up, even if it WAS run at WOT for a couple of seconds, even with 100 miles on it.  This is Bullchit they are trying to feed you.  Contact the MOCO directly.

If it was me, I'd get a lawyer, a free bike, and at the very least all my medical bills/legal fees paid for, plus lost time from work, etc.  They don't have a big toe to stand on....

Dyna, Sorry for the mishap and good luck with your current situation. Imho you should ask the dealership for a copy of their repair estimate and engine analysis. Take those, your medical bills, and your insurance policy and  see a local attorney. The attorney should not charge you for the consult. I would also immediately move my bike from the dealership if you haven't already done so.  Under no circumstances should you give a statement to anyone and I would be careful as to what I might say at the dealership.

I have had similar issues with warranty items, Caterpillar in particular. I have found if you have insurance, the adjuster and the insurance company attorney can work wonders with the dealer/manufacturer with a few pointed phone calls.

In any case, I would never let them get away with that crap.

Keep a detailed record of every conversation you have with the dealer until you get an attorney, that can be very important.

A few years ago I bought a new truck because the old ones transmission went out (and it cost 4 grand to fix it). The transmission in the new truck lasted one week, and they wanted a week "fix" it on warranty and give me a loaner.   They suddenly decided to give me a new truck when I told them I would return theirs through the showroom doors-on a busy Saturday morning.

Glad to hear you are ok.   WOT --- hmmm.  I do recall that we all have a rev limiter at 5400 in the stock ECM and the manual says not to exceed 6400.....

Would totally encourage you to do as recommended here - no more discussions with dealership, hire an attorney, contact MOCO.

I, too am glad that you weren't hurt really bad.  What bothers me the most about your report is that for them to tell you that load of crap, and expect you to believe it, they must think that you are stupid.  And that is exactly what I would tell them, then I would telll them that they can do this the easy way...fix my bike to like new condition and I will take care of the medical bills, or I'll have my lawyer sue them for the repairs, plus medical bills, plus pain and suffering, plus plus plus...then that is exactly what I would do.  This bullchit just burns me up...Good Grief...I sure am happy that the dealer that I trade with is not like that...ever.  Please keep us informed of your progress.

Glad to hear your are ok other than the finger. Could have been worse. Lawyer first, then see where it goes. If you have any documents from the other problem with the oil smell in the fuel that will come in handy as well. Cheers!
