Extended warranty claims.

I'm reaching out to see if anyone has had an Extended warranty claim denied. My extended warranty is with CNA. It was bought from my local dealer when I purchased the bike. Recently my motor exploded and CNA has denied my claim.

Anyone on here ever pushed back against CNA and been successful? I'd appreciate any input. Thanks.

Haven't experienced that but curious did they give a reason for denying claim?

Hondo:

(1) Was the work that was denied performed by the original selling dealer?
      If so, I would expect the dealer to “aggressively” appeal and defend your claim.

(2) Did CNA provide any explanation for why the claim is denied?
      I would think (legally) they would have to have very legitimate basis for denying a claim.

I had three 110 motors fail. Two were complete replacements and the third a total rebuild. Inspector came each time and never questioned or asked for service records even though I’d done all my own services. Did check for trailer hitch however. Must be some reason they are denying your claim.

Yes. CNA said the claim was denied because of an aftermarket part. And yes there was an aftermarket part. And then they tried to claim the aftermarket part (the cam) was the cause of the damage. Of course they have no way of proving what,went wrong first.  Was it the cam bearing, the lifters, the oil pump etc... So since I pushed back against the so called supervisor he changed his story. Claiming it didn't matter what went wrong first. The warranty was voided by just having an aftermarket part. He also refused to provide me with a written report, claiming the written report was proprietary.

Well many Harley owners know the Magnuson-Moss warranty act clearly states if you deny a claim based on a aftermarket part YOU MUST prove the aftermarket part was the source of the problem.

I'm gonna asked my dealer to lodge a formal complaint against CNA. Also looking for a consumer lawyer now as well.

Yes dealer is preparing an aggressive appeal. My dealer did all the work plus all service. An inspector has seen a pictured everything.  First thing the inspector did was to check to see if I had an aftermarket tuner, first thing he did.

That sucks, first I've heard of the "aftermarket" BS especially it not being verified as the cause!!! Good luck in getting this resolved.

Is this on the 2021 SESG with the dealer installed 131? When you say motor exploded, was it failed lifters or oil pump?

So it wasn't an HD camshaft. If it wasn't an HD cam, did the installing dealership warn you of the possibility of claim denial?
It would be nice to know if having an HD camshaft would have made a difference.

Hence my question. The 131 kit I had on my 2017 cvo limited came with a SE 517 cam.

Yes, purchased the 2021 CVO new from local dealer. They took bike from floor to shop to install 131 kit. And that's a great question....."what failed first". I don't think anyone can concretely prove what failed first. Yes I'm sure a master mechanic or perhaps a metallurgist could give a reasonable theory about which failed first. But I don't think anyone can prove what failed first. I could be wrong. Cam bearing exploded for lack of a better word. The lifters were flattened. Cam itself had intense scarring on the lobes. The hole where the cam bearing goes was hogged out so to speak. The cylinder walls were scarred. 

So what happened first? I truly don't know.

It was a cycle-rama 512 cam. No dealer didn't warn me about possible non-warranty coverage.

The CNA ( extended warranty company) supervisor i spoke with changed his tune in mid conversation.  First he was lobbying that the cam caused the malfunction thus since cam was aftermarket deny claim. Then when I pushed back and said there was no way to prove the cam was the root of the problem. He tried to support his claim that the cam destroyed the cam bearing thus causing all the subsequent damage. I pushed back harder saying there was no way in hell CNA or any one could prove that. And under the federal Magnusson-Moss Warranty act of the 1970's unless you could prove the aftermarket part started, caused all the damage you couldn't deny the claim. Then, right then the CNA changed his tune and said. By merely having an aftermarket part voided the contract.  I told him I believe he was wrong and violated the federal act. So here we are.
