California's New Cellular Hands Free law

This is comedy, but it does point out some flaws in an otherwise well-intended nanny law for cell phones :o) Just think texting or using a PC is legal., at least under the current law. If you're weaving all over the place you can probably be cited for careless and inattentive.

The whole of the UK has had a ban on using a cell phone while driving for some time now. Latest talk is that they are thinking of banning "Hands Free" use as well - because of the "distraction of talking to another person whilst driving"

Does that mean that all passengers in the car will also be banned from speaking to the driver?

Washington D.C. has had this law for a few years now. You can't hold your phone and talk but sure as hell can text someone! Go figure!

Actually, I personally like that idea.  I don't like people bothering me while I'm driving, so having a law that requires passengers to wear gags would be perfect for me. :2vrolijk_21:

I get a big laugh every time I drive through Chicago, where it has been illegal to use a cell phone while driving for several years now, and I note how many people I see driving with one hand against the side of their head.  That particular law isn't enforced any better than the speed limits or lane restrictions, and IMHO a law that is unenforced is actually worse than no law at all.  Lack of enforcement just adds to the general disregard for rules and laws. 

We are well past being able to just say "you can't do something" and have the majority obey.  I believe the only way to come up with a workable ban would be to add a low power jamming device to vehicles that would prevent cell transmissions while the vehicle is in motion, or perhaps a similar device in the phone itself that uses GPS data to sense motion of more than X miles per hour.  You want to talk or text, pull off the road and stop somewhere, just like we had to do prior to the invention of cell phones.  Of course, this will never happen so all we get is more useless laws that politicians can point to at election time to show the lemmings what they are doing to make things better.

My latest idea, since the Supreme Court has finally decided that the Constitution does in fact guarantee the right for individuals to bear arms, is to allow us to shoot anyone we find using a cell phone from a moving vehicle.  I look at it as being similar to those special hunts that are often arranged to thin out herds of animals.

With the new law in CA, a biker can longer tell when someone is on the phone, which sucks.  When I am coming up to someone yakking, I would always ensure to be extra vigilent since I figure that they aren't paying attention.  Now it's a crap-shoot.

I saw the person on the phone just be for she sent me and my wife to the hospital last year. Your right, at least I saw it comming and took evasive measures and probably saved us from extreme injuries. Doc

I like the idea of something built into cars that would jam cell phone signals @ x amount of miles per hour.
Better yet ban cars all together!!!!!

Have had a law banning talking on a cell phone while driving in NY for a few years.Just got their head out of their butt & figured you shouldn't text either.Took a real genius to figure that out after 5 high school girls were killed in a head-on with an 18 wheeler.Figure the driver was texting.Don't know why when they outlawed talking they didn't think to outlaw texting??

I think the key here is your phrase "they didn't think".  

I still want to know how anyone plans to enforce any of these basically useless laws.  Sure, in the case mentioned above they checked cell company records that showed she was texting at the time of the crash.  I guess that helps the forensic folks who try to recreate the crash, but I don't see where the ability to tell after the fact is going to be an effective deterrent.

In CA, they are supposed to modify the new law the end of this year to include texting or use of a PC while driving as well. Obviously they're really up to par on what's happening on the roads huh?  :nixweiss:

In California its "hands free" so that includes texting, according to a mc cop friend of mine. He issues a ticket if you have something in your hand.  Doc
