I don't have any "official" statistics from the MoCo warranty folks, but just from reading stuff here and elsewhere it appeared the crankshaft problems surfaced right from the git-go on the '07's, with some really major failures, then the severity of the issue started to decline. Didn't read about many total failures later in the '07 and early in the '08 model years, but still saw reports of excessive runout when checks were performed. Later in '08 the reports had tapered off significantly, and so far I haven't seen any reports on an '09. The most likely scenario still remains a critical quality problem with their supplier that has been gradually addressed through process improvements rather than redesign. Remember, the 4.375" stroker crank was a low volume part only used in the 103's prior to the introduction of the TC96 in '07. Now it is the only crank for all production, and this wouldn't be the first time a manufacturer mucked up when drastically increasing production of a part.
I suggest that H-D hire Howie to be the guy riding the bikes off the end of the assembly line. If the crank survives that initial WOT launch, it will probably survive anything the rest of us would do to it. If not, better to tear it up where they have replacement engines sitting in the wings.
