Update on Myrtle Beach Helmet Law

This is an update regarding the Myrtle Beach Helmet Tickets and the efforts of the freedom fighters who took part.

49 of the motorcyclists who took part in the Myrtle Beach Freedom Ride and who were ticketed for helmet violations have had their cases stayed yesterday.  Motions were filed to have the cases dismissed due to lack of jurisdiction.  The original city ordinance mandated that the violations, which are civil in nature, be heard by a special tribunal created by the city.  However, since that time the tribunals have been found to be unconstitutional (or at least suggested to be by the Chief Justice of the Supreme Court of South Carolina).  The city moved the cases to municipal court.  However, the State Code of South Carolina specifically states that the municipal courts do not have jurisdiction over civil matters.  Since the city served the 49 defendants via mail after the Chief Justice's ruling, they were forced to admit that the infractions were civil in nature since you can't serve a criminal complaint by mail.  That put the City of Myrtle Beach in a box since state code says the municipal courts do not have jurisdiction over civil matters.  The court decided to stay the trials of these matters while deciding how to rule.  The court has stated that none of the defendants need to appear on the scheduled dates.  We expect a ruling soon.  In the meantime motions have been filed in the South Carolina Supreme Court to declare the ordinances void.  More information will be forthcoming as it is made available.

I still don't plan on heading up anytime soon. If I don't have to wear a helmet anywhere else in the State, I shouldn't have to wear one in just one p!ss-ant town.

Fu## Them,,  I can spend my $$$ some where else.... Use to think of MB as a place to play golf anyway, not a biker town, Now I would not spend a DIME there golf or biking....... We had a group of 20 plus golfers go every year for , well they went 35 plus years, me just the last 6, but no more.....

Just don't think that other towns other than MB have the same attitude.  They don't!!!  You are welcome everywhere except MB.

  I will continue to go to the "beach" and have a great time.  Not in MB though..

I didn't plan on going to MB because of what they were doing, but somehow I still ended up there.  Of course, I didn't cross the line into the city limits.  I had a fine time without spending any time or money in MB.  I'm glad to see that they are falling on their face even further now.  I assumed all along that they couldn't make the helmet violations stick.

I'm not one for suing and endless counter suits and all but it'd be just to see those ticketed do so. EFF Myrtle Beach! Great to see the freedom fighters taking on the city.

While in GA last week I ran into someone who manages a nationwide hotel chain sales force. Something like 300+ Hotels. She claims there are many businesses just as pizzed as the bikers. Let's just say the loss of revenue was noted.

Love It, It's the city of MB making asses of themselves not the surrounding towns which is where everything goes on during the rally's and its not hard to stay out of the city limits, If they have the fall rally i'm going, may go even if they don't have it.  :bananarock: :bananarock: :2vrolijk_21:

I am telling all my friends that visit MB for golf and vacations about this crap.  They are l going to go somewhere else from now on....Its to expensive there anyway.

If every town in the USA did this type off stuff it would be a terrible America

Just remember that this all started because City Council was afraid of a lawsuit from the NAACP if they discriminated against Black Bike Week. Now if a Council didn't have the foresight to see the ramifications of their actions, how do you think they are going to resolve it? By being sued by someone else, ie those ticketed. They chose a less vocal group in hopes of the problem going away.

From what I heard it had little effect on BBW.

Most of that crowd stay in Atlantic Beach and don't spend any money anywhere :nixweiss:
