Any Need for a Paper Contract?

I am a business owner from the old school who stands by my word and often do deals verbally. Here is the situation: I'm on vacation at my condo in Florida and I gave my dealer up North in Indiana a charge card deposit on the inbound tequilia sunrise. Do I need a written contract or is the exchange of money via credit card a good implied contract? I have too much time on my hands here, hence this thread. Awaiting your experience and comments!

I purchased my :pumpkin: in '04 from a dealer I had never known/seen before and didn't see them until I picked the bike up. I would request a contract/buyers agreement (and they should want to give you one) but don't worry about it tonight.

My thoughts,

1) If indeed your dealer is "my dealer" a store managed by those that you have had a previous relationship with then if the previous transactions were fine then this may be also.
2) Just by the fact that your questioning us here implies to me that there may be a concern that a written contract should be a part of your agreement.

As in life, we pay our money and take our chances but if there's a shred of doubt then a written contract helps to eliminates that doubt.
Be aware that a written contract does not always mean you will get what you want, it only means that your attorney has a better chance to win in your favor if there's an issue.

It is the dealer that is closest to my office and house. I tried to by the King there last year but could't get price worked out. I don't think that I need to worry but several Tequilia sunrise bikes have been sold while inquiring about them. With the dealers only getting one in each color and someone comes thru the front door with more money than sence, do most dealers honor the original deal?

I don't mean to talk in riddles but an honorable dealer will honor a deal.
I have an honorable dealer I deal with but only you and your past experience with your dealer can determine what he will honor.
As I said above if there's a doubt, get a contract.

Thus far this is how I've held onto the SESG I'm buying from Motor City HD.  So far just the CC deposit.  I did have my credit union contact them to get the VIN so that they could complete paperwork on the financing.  So far I've never heard of a dealer dropping a client who had put down a deposit. :nixweiss:

In the past the "deposit" gave you a place in line and were called in the order of that line.
The current economy has eliminated that "line" in most places.
I cannot imagine a dealer selling a bike to someone else without communication.
Just remember that 1 deal is not so rich that it would warrant discarding a customer for life.
You are worth far more as a Happy customer than a one time premium on a new bike.
It is smart business to sell you the bike. (unless your deal with the dealer was too cheap!)
So I would not worry one bit.

PS that doesn't mean that there are no dopes in business.

With my dealer I didn't even have to give a deposit... there was trust that my name was next to the bike. They know me though...

It's simple, if you don't have a relationship and you're questioning, then ask for a piece of paper... even just a receipt to document what the charge was for... since it appears that you are not that tight with the dealer, they should be more than happy and you'll have piece of mind..

Then look out!! This group will help you spend the rest of your money!!   :bananarock:

The only paper contract that is worth anything is the final sale contract, I wouldn't worry about it.JMO

My two cents. Have the dealer send you an e-mail acknowledgment of the deposit amount, bike serial number, agree upon total purchase price and pick up date. That is a contract.

I just got burned by my neighbor in a verbal contract. I am a general building contractor and did some work for which my neighbor agreed to pay. My neighbor maintained that he was a man of his word too and I believed him. Finally ended up suing my neighbor in small claims. I believed in the system and figured I would get treated fairly in a court of law. The judgement was not in my favor.  I was wrong on both counts, my belief in my neighbor and my belief in the system, and ended up wasting my time and money. Long story, get it in writing. At the very least, you need a record of your deposit that details what the deposit was for.

I have bought three Harley's and two motorhomes by giving a deposit on my credit card, never had anyone back out or change the deal on me.  Enjoy Florida and don't worry about it you will be fine, if not there are plenty of other dealers out there that would live to have your business.

real estate and employment contracts have to be WRITTEN

all others are enforceable oral

a credit card charge is same as taking a check

you should be fine

but anything having to do with dirt - get it in writing or they can legally stiff you

oooooo when i get stiffed on a dirt contract - it just burns me - they can tell you straight to your face with witnesses that they will pay - but if its not in writing its worth less than "simon says"... oooooooooo gets my blood boiling....
