The way I read it, it's not going to apply to anybody except the person that got the attorney to file the claim. :nixweiss:

We just settled a lemon law suit with BMW of America and it didn't have that hush, hush clause in there.  And, walked away with the loan paid in full, attorney paid and a full refund on all payments made for two and a half years.  We had to pay them back a "use" fee but that was very minamal in comparrison to the payments made.  We were very happy with our settlement.

In comparison, I don't see the MoCo offering up much here except to get the attorney off their backs. :nixweiss:  For instance, it shouldn't be a 2 year ESP.......it should be an additional two years of "factory" warranty. :2vrolijk_21:  It appears the attorneys want their money and run.  I don't think they've done their job.  I'd line through and initial each clause that I don't agree with, send it back to them and tell them to get on it, they haven't won the battle just yet.

You've hit on the big "secret" involved with most modern class action filings.  It's not about the members of the class, it's all about the law firm raking in big bucks to quickly settle and the class members get diddly.  Been there, done that, doubt if I'll ever get involved in another such deal.  My advice, if someone has a real and significant claim, is to opt out of the class action BS and go it alone with a good attorney.  Then at least you and you alone get to decide if you are willing to take a pittance so the attorneys can cash in.

I got the same exact email from the law firm..The only problem Ive had so far is the stalling problem..Seems to be in the kill switch I think..While riding a few times the engine just died..I reach up and turn the kill switch on then off and everything seems fine til the next time it does the same thing. Now how do I go about getting the 2 year extended warranty?

the man  cAn  post whatever he wants about his case  it called freedom  of speach for u crying obamanites i know  ive defended  that right  for half  my adult  free country,  to hell with  confidentiality  crap.  some lawyer tell you , that u  cant talk?    id want to know and so would  evereyone else  that has this problem

Mine just started this weekend with the low oil pressure, stumbling/stalling and overheating on a 2010 with +7K miles!

The document that was posted specifically said the reimbursement for Harley's cost (without specifying what discount Harley might get compared to real riders) for a two year ESP.  Whatever the amount might be is worth collecting.  But the wording made it seem certain it wouldn't be a full reimbursement for someone who'd already laid out the coin.

Note, this is only a proposed settlement, and nothing is actually finalized yet.  Considering that H-D and the dealership both make a tidy little profit on the ESP, I'm guessing H-D's cost on it is about half of what most people paid for the coverage.

Hello every one.  Just bought a 2010 SECU on Saturday.  The heat this thing generates is scary.  My primary case is as hot as my pipes.

Are any of you experiencing this?  Can I assume that the settlement I just read on this thread is regarding this problem?

Incorrect.  The proposed settlement applies only to bikes that were covered in the 0905 and 0906 service programs.  Neither extend to your current model bike.
