You may be on the right track. My friend had the exact same problem, no cruise, rear brake light always on. It turned out to be a broken brake switch inside the right hand brake assembly. He had it replaced, cruise and brake lights now work perfectly. 

replaced on warranty ? Is there an issue with the hand brake switch ?

Does this mean anything important or do i have to worry about (the codes did not return after clearing ) but where did they come from ( perhaps when the dealer did the supertuner and the dynos ) ? Thank you for the quick answer .
Probably were  historic codes

I had a probelm with my cruise control on my 04 and even replaced the "cruise set/resume" switch on the handle bar. After soldering it all in and putting it all back together, it still didn't work.. That was 3 hrs of a waste and a 60 dollar switch. I then tried unplugging one of the wires that are connected to the thottle cable down by the gas tank.  That connection lets you roll the throttle forward to turn off the cruise. Well I did that and now it works perfectly.  I know that was my problem all along now. Oh well,  I had nothing better to do on a lovely Saturday afternoon anyway. :'(

Sounds to me like whoever swapped out your handle bars did not deal with the brake lever switch correctly. There is a little button/switch inside the brake lever assembly that gets depressed when you grab the brakes. This switch is what cancels cruise if it happens to be on. I'm not sure about the newer bikes but the same thing happened on my '03 Road King. If the handlebar controls are to be removed, one is supposed to put a small shim in between the brake lever and the cruise switch to keep the switch depressed. If this is not done, the switch can get broken quite easily.

Good luck getting this fixed under warranty, especially if you've swapped the handlebars. It is not a warranty issue... it is failing to follow the correct procedure during the handlebar swap. If you paid someone to swap your handlebars, you should get them to fix it because they should know better.

if it is the brake light switch, it is held in place with a small brass insert that should be held inplace with a small amout of sillicone. That would make the cruise act up for sure. Easy fix if you can find that insert.

Just had this same problem on a trip this past week.  It was the front brake switch.

I had my cruise working intermittently.
I would also get a check engine light intermittently.
HD changed the cruise switch assembly on the handle bars.
All is well for 5K miles now.
My brake light did work normal.

Had the same problem.......

Would be out cruising', stop for some reason (turn, red light) get moving again and hit the restart on the cruise control.

Problem was I had the cruise set for 80 and I was in second or third gear.  When the engine rpm's neared the rev limiter it cancelled the cruise control.  Just happend to be looking at the tach when it dropped out.  Up-shifted to a higher gear problem hasn't reoccurred.

If you had someone mess with your wiring (ape Hangers ????) that might be the place to start looking.
