Well the verdict is in.  A guy who was defending himself from axe wielding attacker with known violence issues was convicted of murder and faces a 20 year sentence.

A little back ground on this story.  When this all took place, a county grand jury decided that there was not enough evidence to bring this guy to trial and was a self-defense situation.  That was not good enough for the state and tried the guy and he was convicted of murder.

It is so wrong in this state in many ways.  You can carry a gun without a permit, but if you use it in self-defense you will go to jail.  This is the third one I can think of in as many years.

Sounds to me like the first shot was clearly "Self Defense".
The second shot, "in the back", not so much.

Bad situation and brings the question; "Should your first shot be to kill or disable?"

I think, if in danger, aim for center mass and fire until down...then call a lawyer, the NRA and shut up.

Only had to unholster once and that was enough to send the idiot running...glad I didn't pop him in the back...

What is missing is that after the guy was shot, he kept coming at the guy who shot him.  

Also, he was shot in the buttocks not the back.  In the three years this as been going on, only once did it mention where he was shot.  

The family of the dead guy fought like hell not to have the autopsy report released.  Apparently, the family of the deceased thought it is an invasion privacy to the release medical records of what actually killed him.
