Thanks for all of the well wishes. The wreck happened at 5:45 pm in broad daylight.  No idea what that deer was doing out at that time. Anyway, I talked to the Harley shop today, they said if were a regular Street Glide it would be totaled without a doubt, but since it was a CVO it takes alot to total one out. I just wanted them to know it was perfect before the accident, I expect it perfect when I get it back. No more... no less. They assured me that they know the Progressive agent and they have never had a problem with them writing a check to fix one right..... I guess we will see.

My guess is they'll total it out, IF you don't agree to re-painted parts.  That's what just happened to mine once I said NO to re-painting and they priced the tins from the MoCo.  I was dealing with Progressive also.  FWIW.  spyder

I am sorry for your mishap, but you ended up very lucky,

The "down" time will be excessive for the repair. Also "marks" the bike for future sales disclosing the extent of the repair.

They (insurance company) also want to be cut loose of the liability and the future liability, if the repair keeps costing them money.

New Bike 35K

damages 20K?

salvage value 10K?

they buy the new bike 35K minus salvage approx 25K

and they are done completely.

at 20+K they are still on the hook.

only 5K away from new bike

frame?
harness?
engine?
loss of use?

I think you could put together a good case for a new bike

could be close

Glad to hear you are upright and ok for the most part. I sure hope you have good luck with your insurance.
I had a deer accident in 2000. Had a deer jump out of the ditch and I hit it. I walked away from it but my bike was totaled. I had Dairyland insurance and they were great. I got the price of the bike and was able to buy the bike back from insurance for 10%. I ended up fixing the bike and sold it for a little profit.
I thank God that you are ok.

OUCH! Sorry to hear of the deer collision! I feel your pain!! We are overloaded with deer up here in the Northern regions of Illinois as well. I have had several close calls this summer. It doesn't even have to be dusk or dawn to have them jump right out in front of you. The do it at all times of the day here. I know when I see one that there are more hanging back and fortunately have been able to do some fast maneuvering to avoid but I do worry about it. I see a nice new 2012 CVO in your immediate future and may your road rash heal quickly!

Well guys, an update on my deer crash. I am doing much better. Hands and arms healing very fast and almost good as new. I wish I could say the same for my ass, knees and leg. But... they are getting better.
The insurance is working out decent. What was explained to me as a complete replacement policy, turned out to be gap coverage. So they wont replace my bike, but they did pay it off and are reviewing the phone tapes, to see if they did explain it as a complete replacement.  They said they will pay for the tax, title and license on the new one.
My wife did some calling around and found me another 2011 black and crimson. In Peoria,IL so I sent them a down payment to hold it for me, to get this insurance mess straightened out. They said that after reviewing the phone tapes, they might cover the freight and prep charges. Either way my new cvo is waiting for me to sign the papers. Hopefully next weekend I will be back in the saddle. I have been going through withdrawl not being able to ride. Plus my annual labor day weekend trip to the smokies is fast approaching.
Thanks again for all of the well wishes....

That looks like the most reasonable conclusion to end the incident.

Good luck with your next ride.

Glad you are ok and sorry your bike isn't.  My first solo ride on my SEConV scared me.  Big black dog ran in front of me followed on the heels by another chasing it.  My front tire bumped his ass but didn't drop me.  He was startled for a second but kept running fast.  Thank goodness the second dog ran behind me.  I was doing only about 38 on a country road.

I totalled my 05 Heritages Softale Classic a few years back when a deer tried to ride on my front forks.  I had my policy with Progressive at the time and made sure that they had everything listed out for them that came stock on the bike and everything I did to upgrade it.  I was able to pick up an 08 Street Glide all decked out for about $8K out of pocket.  I'm sorry the insurance company isn't treating you better than they are - sounds like they weren't really clear in their discussions with you about your policy.

It took me nearly 6 months to get back to full working order.  The road rash was the longest to heal up, even though I was in full leathers I still suffered some "rug burns" from the lining, I really feel for you and hope you keep active so that your muscles don't sieze up on you while you recover.

Well guys, I have to give Progressive a   :apple:

They reviewed the phone conversation I had when I purchased the bike and actually admitted that " I WAS RIGHT " the agent did tell me it was a complete replacement policy. So they are going to honor what I was told and cover all costs for me to replace my bike. They are even going to pay for me to drive to Peoria,IL ( which is. Aprox. 400 miles round trip)

Its nice to see an insurance company be honorable and not just say " sorry they were wrong and you are screwed".

Saturday morning I will be picking up my new scoot and will get to enjoy a nice little 200 mile cruise back home.
