15 mph over in FL. , lose MC?

can someone in fl. tell me if this is true,if your caught going 15 mph over the speed limit you can lose your mc?

Noway. I've been caught 20 mph over the limit. BIG ticket , that was it.

That is even crazy by Florida standards........

maybe they could impound a bike, but doubtful for only a traffic violation.

20 mph or more in Calif. can be "Reckless Driving" and at the discreation of the officer, they can impound your vehicle and arrest you for a misdameanor and take you to jail.  At least that's what I was told by an officer a few years back when I used to ride fast.  :nervous:

I've seen reports elsewhere concerning the same subject, except it was about a supposed law passed in 2008 that made traveling at more than 30 mph over the limit the threshhold, not 15 mph.  And like most laws, it didn't say they definitely would confiscate the vehicle, it just said they could confiscate the vehicle, take your license for up to ten years, and possibly chuck your azz in jail as well. 

I would imagine this law, if in fact it really exists, was a response to all those 180 mph crotch rockets on the market these days.  Or maybe the Lambo's and other supercars found around places like Miami.  Shouldn't be a big problem for normal relatively sane people.

He's likely referring to what was HB137.  A bill in the Florida legislature that got some national press back in 2008.  Was written and sponsored by some dipchit state Congresscritter that did a ride-along with his local cops and got so freaked out by seeing a biker do a few wheelies that his panties got in a major wad against motorcycles everywhere.  The Bill came out of Committee but never passed the full legislature.

Ok, just looked and found the Bill.  Here's the language.  It failed in the Florida legislature (for a variety of reasons).  Here it is purely for amusement's sake:

F L O R I D A H O U S E O F R E P R E S E N T A T I V E S
 A bill to be entitled
 
An act relating to offenses committed while operating a motorcycle; creating s. 316.1926, F.S.; providing additional penalties for certain offenses committed by a person operating or in actual physical control of a motorcycle; requiring that the person be taken into custody; providing for seizure and forfeiture of the motorcycle; providing for revocation of the person's privilege to operate a motorcycle; providing an effective date.
Be It Enacted by the Legislature of the State of Florida:
Section 1. Section 316.1926, Florida Statutes, is created to read:
 
316.1926 Motorcycle offenses.—
 
(1) When a law enforcement officer charges a person with reckless driving in violation of s. 316.192 or exceeding the speed limit by 30 miles per hour or more in violation of s. 316.183(2), s. 316.187, or s. 316.189 while operating or in actual physical control of a motorcycle, the officer shall arrest the person, take him or her into custody, and seize the motorcycle, which shall be subject to forfeiture under the Florida Contraband Forfeiture Act.
(2) Upon conviction, in addition to any other penalty provided by law, the court shall revoke the person's authorization and privilege to operate a motorcycle for a period of 10 years and order the person to surrender his or her driver's license.
(a) If the person holds a Class A, Class B, or Class C driver's license, the department shall issue a replacement license, valid for the remainder of the person's unexpired license period, without the endorsement to operate a motorcycle.
(b) If the person holds a Class E driver's license that is not restricted to motorcycle operation only, the department shall issue a replacement license, valid for the remainder of the person's unexpired license period, without the authorization to operate a motorcycle.
(3) Revocation of the privilege to operate a motorcycle under this section shall not prohibit or restrict the issuance or renewal of a driver's license for purposes other than the operation of a motorcycle.

Section 2. This act shall take effect October 1, 2008.

Don't know about FL but in Georgia 29 mph over will earn you about an hour stay in the back of a state patrol car!

Motorofficer I know went by the "10 is fine, 15 your mine"......He set a SO record with over 600 in a month, like 4 an hour.... yes a dick he is too.

They are still making a fortune on on SR98 tween I95 and the swamp...Limits are 45 in some spots 50 in others..I drive it 2x a day or more..... I have been cut loose on Flas turnpike  by a fine outstanding State Trooper...I was going as fast as a rented ford taurus could go, speedo buried at 85...When finally nabbed he mentioned it took him several miles to catch me but I used my directional every lane change, he let me go....Took forever to get home at 65... :coolblue:

KY. mandatory jail for 20 over. Not sure its always enforced but I know someone who didn't make it to work one morning doing 65 in a 45 in a cage. No was not me but a close friend. He spent the morning in jail until his mom bailed him.

On the I-4 corridor in Central Florida if you go at the speed limit, you get run over. So you go with the flow . Usually 10-15 MPH over the limit is the norm.

Here in Ontario, Canada 50 KM over and they seize the vehicle on the spot for a week.
