I agree.  But none of that would help this gent get his refund.

Just spent a few minutes doing completed auction searches at eBay.  The completed auction search tool doesn't search back an extended time.  Looks like about a month.  But during the time frame the utility reaches didn't find this listing.  In fact didn't find any 2010 Harley of any kind sold within 50 miles of Branson.  A Craigslist search for the areas of Springfield and Branson, MO and the adjacent areas in northern Arkansas didn't find it either.  The gentleman will need to provide specific listing information to know who the seller is so he might be avoided.

Might not help him get his money back.. but it'll make everyone else wary of this seller and make good probability it never happens again.

$1000 for NOTHING is just plain crap.

If the OP would post the seller's name and screenname I could keep myself entertained for a few hours.... :)

Nick from Australia ~ can you provide us with more info?  When did this transition take place on EBay?  Can you post (is it possible) the original listing?  If you saved it to your computer, you can post it here on the forum.

I LOOKED AT THE Ebay policy and I think they have committed fraud in not delivering the bike?  Please refer to The verbage about 7 paragraphs down.

Now that would definitely end a police officers career!!

I belong to another forum and when this type of thing happens, everybody bands together and tortures the individual untill they pay. It has worked very well. They will contact employers, neighbors and even blanket the entire community with an email if need be.

Don't want to begin to consider the various exposures that could open the site or its members to if there's even a hint of collective or other organized efforts.  A little vigilantism may be good for the spirit.  But it can be bad for the pocket book.

I would hope that no one on this forum would do anything that could be considered problematic.   :rifle: I like anyone else just wants to be able to get enough facts so that properly informed "we" can give him a knowledgable answer that helps him recover his deposit or at least prevent this EBay scammer from ripping off another victim. Never intended to take vigilantly matters in my own hands.  :knife: :behead: :hanged: :beatdeadhorse:

Hi every one,

Thanks all so much, i have called both ebay and paypal both in Australia and the USA to no avail, he now just sent an email offering $500 back only

He is telling ebay because i didnt complete the transaction within 7 days i broke the policy, its true i didnt but he took a while to give me the details and then i had to make many calls to the bank to get the correct swiftcode and details to try transfer the money, the problem was he owed $21200 to harley finance and it was harley finance i had to pay.
now the tricky part was when i tried to wire the money i was sending to New york melon bank to harley finance and there was no provision to add a another third party and the bank told me it was risky so i called him and explained that i may need his personal account to transfer to where it would be easier but i would send $50 or a small amout just to make sure it went though and he received the email receipt from my bank.
i kept calling him asking if it went through (he would never call just email) theb when i got his personal account details he told me he had others interested in it, i will attach an email back and forth from him

The brother is a liar saying i didnt have the money and had to borrow it and i couldnt complete the transaction, i did have to borrow it from a friend but i explained that to them before i bid in a phone call and the money was ready to go before auction ended

This was expressed in writing in the listing for everyone on eBay to read! Full payment was due on the 27th of January 2012. Once payment wasn't received I could have re-listed the motorcycle and or sold it, however, I attempted to work with you as a courtesy.
Nick with all that said, I'm willing to refund half of your deposit ($500) and not a penny more. Your failure to pay has cost me selling fees on the full amount of the motorcycle along with the loss of listing fees. If this agreement is not acceptable by you, you'll get nothing! If an attempt to dispute through you bank is done, that will go through PayPal who already has this information and it will once again be denied. Five Hundred US dollars ($500) is my one time offer Nick.

I can tell you first hand that transactions between Australia and the US are NOT easy to accomplish. There are differences in the currancy exchange rates for each country, bank account and bank routing numbers unique to these type of transactions and of course a international payment entity called SWIFT. Because of the need for security and the preservation of the funds at each step delays are experienced until the funds are validated as being legitimate.

All of these things cause unexpected delays in the money arriving where each party would like for it to and when it is expected. Further, tracing transactions is very, very difficult. 

I know all of this because I have over 35 years in the Banking and Financial Industry AND I recently experienced ALL of these issues when I sold a HD Destroyer late last summer to a GREAT guy Australia.

We both tore our hair out trying to make things work using the same payment systems which as in this transaction finally worked out just NOT in the timeframes we wanted.

SO with all of this in mind, I would hope that the sellers would realize that;
1. They got what they wanted for their motorcycle from someone else.
2. They shouldn't profit from a deposit on a transaction that they didn't complete despite the best efforts of BOTH the buyer and seller.

I stand by my initial recommendation. I would now definitely involve the Branson, MO Police Department Internal Affairs Department if I wasn't made whole and received my $1,000 back ASAP!

That's about all I can contribute and I sincerely hope it works out.

Seeing as how the Branson PDs seem to have a "small town PD reputation" you may want to take that inquiry one step further and go the the State Police agency that oversees the Branson PD.

Well he might want to receive lots of mail over there. Since he's a sworn officer of the law he might just want to use common sense and logic and return all of the money once he understands how the international payment systems work.

I have contacted my bank as the money from paypal was drawn on my VISA and reported is as fraud, i have also sent email to the Branson police investigator, police officer or not i will take this as far as possible because he is a thief and a liar  
It maybe a civil mater if i lived in the USA but i live in Australia and this is Internet Fraud, i will use the full extent of the law whatever it takes what ever it costs to get justice and stop him doing it again
