Totally agree.  When my MC was totaled 300 miles away, the dealer there gave me an estimate.  I was entitled to a second opinion so I questioned the quote from that dealer and requested that it be brought back to my local Harley dealer.  The insurance company coughed up the shipping fee to get it back here to my local dealer.  That was 1 year and 4 months ago...., it is still sitting at my dealers totaled and I have never been reimbursed for the MC yet.., :-\. But, that is another story.   :(

 :jack:  :soapbox:  CVOgirl, this is a crock of crap!  Good people should not have to go through this kind of run around.  I applaud your effort in getting justice in this accident case.  Had a former father in law that sold State Farm insurance in NE Alabama for 45 years.  Unless it was something that was an obvious insurance fraud case (he only had a handfull in those 45 years...very honest and good man who has passed on now...will be missed), he ALWAYS sided with the policy holder.  Not only was that the honest thing to do, it was the right thing to do and kept that person along with family members coming back to him.  You would think companies would want loyal customers but it's becoming a thing of the past these days as they just want your money.  I hate to say but have heard this kind of problem concerning American Family policies on a regular basis (have a good friend still sells State Farm).  He gets quite a few converts from them along with policy holders from another major company (won't say the name but they always want to know if your are in good hands... ::))  Sorry you have had so many problems but sounds like justice is just around the corner....good for you!   :soapbox: :jack:

Like everybody else has said, you would be much better with you mangled mess at home. I have been to the Asheville shop many times but not in the last several years. Does Gene Lumas still own it? He was a great person and could be trusted without doubt. I live about an hour away and would be more than glad to do anything I could to help, check on progress, etc. But it remains "Get your scooter home" is the thing to do. If its a total it all becomes a non-issue. Good luck!!!

Gene Lumas passed away and now his son, Travis is out of the business.  Gene was a truly 'old-school' biker that is already missed by many.  I have only heard good things about the Asheville shop by way of 2nd hand info tho.  My '04 SEEG was damaged less than this bike and it was 'totalled' due to cost of replacement parts alone and bent frame tab.  Shouldn't be an issue there.  spyder

Yes, it is a sad situation that I am going through with this company Utrarider1.  I had a $5,000 pay out that was to help with my medical costs and they were to release that within the first 30 days.., I received that exactly one year later.  I have a great attorney that has been practicing in this field for 27 years and he said that this is the most fraudulent case he has ever handled.  To date this company has violated 7 State Statutes that we are also suing them for.  We have requested a jury trial and if I win those statutes there is no cap on the monetary amounts I could recover.  At this point my attorney say's that this lawsuit has the potential to be worth 1 million $.  All this because this company tried to steal 10k from me.  They have all ready racked up 50K in attorney fees.  The agent that sold me the policy left the company 3 weeks after my accident.  The company refuses to disclose if they fired her or if she left because of what they did to me.  We have a hearing with the Judge Weds, Oct 3rd and he will rule on if they must turn over her work records.  Everything with this company has required one hearing after another and one delay on top of delay.  My court date has been changed 3 times but the Judge has promised my lawyer that there will be no more delay's..

My advice to Joe would be that if Asheville HD doesn't find his bike totaled than he is entitled to a second opinion
and he gets to choose the dealer.  That is when he has the MC brought back to his local dealer.  I also saw his MC when they were loading it on the trailer and that MC cannot be anything but totaled.  If the insurance company starts talking about changing out the frame than Harley will stand behind Joe.  If there is one thing the MOCO will do it is stand their ground if the frame is bent.  I hope Joe has a better insurance company than I had when I totaled my MC.

Sounds like you are going to be fine afterall. No amount of money can replace your medical issues, but now that you have gotten over most of it, you deserve a good payday!!!! Hope the Judge gets sick of their antics and delays!!

A Harley frame is easy to bend especially at the neck. Back in the day they would put your stripped frame on a jig and straighten it. If you look in the back of any old HD Manual you will see all of the frame measurements. In this day and age I think it is B/S to straighten a frame. If you are going to strip it down REPLACE it!!!!! It really doesn't cost that much more when you consider peace of mind!!!!! I hope both of you get things straightened out. I really hate insurance companies!!!!!

Hi Everyone,
Thanks for all of the replies and the good advice.
 Joe is feeling fine physically, the road rash is healing, and he is in good spirits. He has been riding for over 50 years and has had his share of unplanned "adventures" with his bikes. He's quite happy to still be able to talk about them. He is presently waiting for the insurance company to make a decision on the bike. Looking at the bike I would think that it is a total loss, but the service manager at Asheville has said that due to the high book value of CVO's, the insurers often go the repair route. We shall see.
 His Road King is at his dealers shop but they have not diagnosed the problem yet. They have a big backlog of broken HDs of all types! Not surprising.
 Our best wishes to Judy and wish her success with her long drawn out battle with her insurance company. Since they have deeper pockets than most of their customers, the crooks out there try to wear you down with delays, paperwork, hearings and other assorted BS. Stand your ground girl, you have the truth on your side. I predict that just prior to any trial, they will come up with an offer. Tell them to keep it! I would take my chances with a jury of my peers vs: an insurance company any day. Good Luck!

Have the bike repaired near your home.  If you have any issues regarding the repairs, what are you going to do - take the bike back to Asheville?  What if you have an issue that requires several trips back (not unheard of when repairing a bike).

Joe's bike is 800 miles from home (approximate). If it were me, I'd either have it shipped up or go pick it up if not totaled.
I would not want to have to deal with the long distance repair such as that and the the problems that are sure to arise post repair.

Borrow/rent a truck or trailer.. The cost and time could be money well spent towards future aggravation. Not to say you wouldn't have problems locally, but at least they would be local.

Update: The insurer has not made a decision yet on whether to repair or total. They have authorized further disassembly of the bike to assess extent of the damage. If the decision is to repair, we will one way or another get the bike back to Joe's dealer in New York, for repairs. Of course he is hoping that they total the bike.
As far as his '10 Road King, catastrophic lifter failure , caused a lot of internal damage. This is a 103 cu in motor, with 5000 miles, built by his dealer when the bike was purchased new.. They will repair under the extended warranty. So it looks like Joe just might have both his bike at his dealer's intensive care unit. Only good news is that winter's coming.

Yes....luckily he is still there......I don't know any of the techs there and how the work is. The one good eng builder they had is no longer there. Can't think of his name right now. Hopefully they got someone else good to replace him.
