Is'nt the VIN number on the frame.....how would that work???

If they need to retitle it....I would ask for a new bike.
The MoCo can supply a new frame with his existing VIN as long as they get the old frame (in some cases they only require the VIN stamped neck of the old frame) back.

The new frame has the same VIN.  On the old frame, you cut the neck off where the VIN is stamped and send it back to Harley.

I wonder how it would show up on "CycleVin" (CarFax for MC) or other motorcycle history reports?  I don't think I would buy a bike if I knew the frame had been replaced...if I did it would have to be a bargain!

The good news is the MoCo agreed to fix the problem, and it is arguable if they should give you a new bike.  The bad news is that your concerns are justified in that the vast majority of dealers are not qualified imo to take this bike down to the frame & reassemble it to factory specs.  Furthermore, MoCo will only give the dealer x amount of hours to reassemble the bike & all the electronics, etc. and that is something that dealers do not do on a regular basis.  Therefore there may be shortcuts, lack of proper torqueing of parts, and other priorities of the dealership which cut into the proper assembly of your bike.

Best solution imo would be to either leave as is or see if you can't apply pressure to customer service and/or dealer to replace the bike. I doubt that they are legally obligated but a good attorney might motivate them.

Sorry to hear your news!  You paid a lot of dollars and deserve a top quality bike and assembly.  Maybe find out who will assemble the bike and how many have they done.  You probably won't like the answer.  If you leave the bike as is, will the subsequent owner pass on your bike for a one without obvious blemishes?

Man, I feel for you!

I would do "everything" I could to see that the dealer/MOCO takes back the bike and give you a new one and let them deal with the frame issue and potential "diminished value" as a result of a bad frame...I just can't see how any dealer could put it all back together as well as a new one from the factory...shortcuts, missing gaskets, torque specs not followed, alignment with all parts/fiberglass/steel, "oopsie" on the paint, chrome and bolts while wrenching (and it won't be their senior mechanic working on this, probably some "trainee" taking it apart anyway), loss of use etc.

I would be polite but forcefull and serious initially, but if this fails I would go legal...this should not be your issue, but theirs to deal with!

Yes the frame carries the VIN.  The distinction being that it's the same VIN.  So nothing to re-title.  A bigger concern will be that a frame change is in the bike's service history.  Put yourself on the other side of that sometime later when buying that as a used bike.  No matter what anyone tells you; if they do their homework and find this history they will never believe the bike wasn't wrecked.

The bike came home after PDI and an accepted personal inspection.  There's no safety nor other mechanical flaw so Harley isn't buying it back; not for cosmetics.  I might worry about a shop R&R'ing all the parts; and I might not.  Depends on the shop.  I definitely wouldn't want the service history.  Of course if the warranty replacement part has already been authorized against the bike's VIN the history is probably already in place.  If so you're already screwed so might as well let them change it.

Thay are gonig to build a new frame and use the same VIN on it. The dealer will return the frame back to the MOCO!!!

I know many Master Techs that work at different dealerships. I WOULD HAVE NO PROBLEM doing the frame swap. A dealer will put their best man on a project like this. A good tech can do the turn around in 2 days or less. It will be better than new!!!!

They stamp the same VIN# on the frame and the dealer has to cut the neck with the VIN# off the old frame and they have a small time frame to get that back to HD or big fines will be handed out. I agree if they won't replace the whole bike and there is no safety issue leave it alone.

Here in CT if the vehicle has the frame replaced, or other "major  components" and the VIN is different on the new frame (not sure about happens if the factory gives you the same VIN) it has to be inspected by the state Dept of Motor Vehicles with both the vehilce anmd paperwork checked then they will mark your title REBUILT and that distinction stays in the records forever  ---- My Ducati had the frame replaced under warrantee due to structural issues and now the bike is titled as REBUILT and therefore if it ever comes time to sell it will not bring top dollar and I will probably still have to explain the whole thing and pull out the old paperwork to show the bike has nevfer been wrecked...

HD will issue a new frame with the same VIN providing the dealer cuts that section off and sends it in.  This what they do if you wreck and bend your frame.

just my opinion, i'm with some of you guys,,,, i think the MoCo should replace the whole bike and i wouldn't be to keen on the idea of tearing down the bike to replace the frame.

Replace the bike, ask yourself "do you really trust the dealers wrench?"
