What's the penality in your state for a auto like that?  spyder
If your a collector, no penalty if your not carrying it.  Law enforcement and EMS it is legal to carry under 4 inches.

If you are just carrying it, not using in a crime, and not with the intent to go armed its a class "C" misdemeanor.  It is a possible up to 30 days in jail and possible fine to 500 dollars.

I have been caught twice with one on my possession in TN.  Stopped for speeding and had to let the officer know I had a loaded 1911 in my waist band.  He then made me empty my pockets.  Said nothing about the knife 2 1/4 inch blade benchmade auto, and gave me a warning on the speeding.

Random boat search for safety equipment and saw my Protech 3 1/2 inch auto when I was getting my registration.  Asked to see the knife, looked at it, admired it, commented how sharp it was.  All safety equipment was good and he let me go on my way, not a word said about it being an auto knife.

I'm just assuming that most state's laws are similar.  Seems that the laws against auto knives are out-dated esp. in light of the newer one-handed opening devices on modern folders that rival autos for opening speed.  Almost makes carrying our autos 'not worth the risk' anymore.  I've about stopped carrying my auto Benchmade Presidio for that reason...other options without the hassle.  8) spyder

That is a nice looking, well made little knife. Do like the belt clip attachment. How dose it hold the edge?

I was given a Gerber automatic folder by the 7-17th CAV while I was in Afghanistan working as a contractor on US Army helicopters.  I have carried it on my belt for two years as a civilian in Tennessee without any issues.  I have had several LEO's ask to see it and explained to them that as an aircraft mechanic, I was often perched on an aircraft working using one hand to hold on and using the other hand to perform work and used the automatic as a cutting tool which only required one hand to use. The only thing that the LEO's have said to me is that it is a fine blade and handed it back to me.  This has happened several times to me while within the secure areas of the airport.  The majority of LEO's are very professional, common sense people and know the difference of a law abiding citizen using such a tool and a person that really has no excuse for having one on their possession.  Thank God for common sense.

Most areas allow spring assist, but definitely check before carrying. These are great and for the price you can toss em in a few years if you really beat em. Not the prettiest, but they are slim and work great for pocket clip carry. Glass breaker works well too. Very sharp and strong lock up.

It is a really cool knife.  Opens with just a flick.  4" long folded, 3 1/2" blade.  The belt clip is interchangeable on either side of the knife.  I got it on EBay for $35.  It has a great edge and will split a hair.  :P :D

I've lost more knives than I can remember. With that said, I try to keep any knife purchase under $50. Now I have an inexpensive folding Gerber, that works just fine.

When I used to fly I carried a boot knife with 5/50 cord wrapped around the handle. For a survival situation, it was a good way to carry some essentials without having to think about it.

Benchmade is great. Carry it daily. Opens a box faster than any knife I've ever had.

I've always had good luck with Cold Steel products. My last purchase was a trench tomahawk. You gotta be ready when the zombies attack!
