Cracked chopped tour pak lid with aftermarket backrest

Has anybody experienced this? I have a '09 model chopped tour pak with a Corbin backrest pad (picture shown) that I noticed last fall the lid had cracked at the front right corner on the outside, didn't go all the way inside. I contacted the dealer I bought it from, which was Tri-County HD in Fairfield OH. I took it my my local dealer who took a picture of it and sent it to Harley-Davidson. They had a local painter repaint it and I reinstalled it over the winter. Harley-Davidson asked the local dealer for their recommendation and that's what htye came up with. The was relayed to the dealer I bought it from. I was concerned about matching up the CVO color for one and fixing the crack and repainting. We rode yesterday for the longest ride since winter, about 7 hrs, and I noticed at one stop it was cracked again, just like before.

Has anyone experienced this with an aftermarket backrest? Of course the local dealer blamed it on the backrest and Motherwell detachable tour pak mount. I disagree.....what should I do now?

Ive had a number of them crack over the years, Your Dealer just put a bandaid on , Paint just hides the crack till it cracks again,  the fiberglass Ones I took to a corvette repair shop and had the crack reinforced and repaired, then painted, I would check, Not sure on the 09s but I think my 2013 tour pak is plastic Im guessing a thermoplastic welder would make a permanent repair. Hope I don't have to find out lol

Do you think that the height of the TP pad is at a height that when pushed back against it it is placing pressure on the lid? The back rest is acting like leverage against the lid.

Replace the lid and backrest pad and try it... If no issues reinstall the taller pad and see what happens.....

On a side not note, how did the painter do matching the paint?

Puzzled....I am starting to wonder the same thing about that height, as far as replacing the lid unless I have a spare lid laying around that will be difficult, and I don't think I will run out and buy one. I am considering replacing that backrest pad for a HD one and go back to the dealer with the crack again.

Really not sure on the paint.....looks close but am I 100% sure, no, had to trust the dealer's painter
