never understood this helmet law
« on: August 02, 2011, 06:45:51 PM »

I have been riding in Delaware and never understood their helmet law.

Recently the legislature tried to remove the restrictions and the Governor vetoed the bill.

What is so unusual about this is the Delaware law as it stands right now,
You are only required to carry
a helmet, not required to actually wear it.

Are there any other states with a law like this?

I do not know about any states but in Greece the law is that you must wear a helmet but if you have a helmet with you they will not pull you over. If there are 2 people on the bike only the driver requires a helmet. They don't care if the passanger has a helmet or not. If you do get a ticket it is $360.00 EUROS which is over $500.00 dollars. :nixweiss:

Years ago Illinois passed a helmet law but it was just never was given an actual "take effect" date.  If you look on page 3 of the HOG 2011 Touring Handbook you'll see all the latest safety helmet laws state by state.  Some interesting restrictions/exceptions.

I have been on a fire department for years and can say I have seen people saved because of a helmet.

While I agree with the fact wearing a helmet should be the owners/riders choice,I am also going to say I am still here because of one.

IMO its like this....
While many feel the freedom of no helmet may be their cup of tea,its not mine. The way I look at it is if you feel your head is worth nothing to you, then you go without a helmet.I have been across the hood of a Honda many years ago and smashed my skull on a sidewalk curb due to a uncaring person who turned in front of me with no use of their signals. That laid me up for a long time and kept me off a street bike until just recently again.Wearing that Simpson way back then saved me and gave me a chance to one day ride again, there will always be a helmet on my head,no matter what the weather or laws state.

I'd venture to say that while the Delaware law may seem a bit odd to you,its probably a liability deal and their way of covering their rears.

Many years ago Indiana law simply said "Wear an approved helmet", we wore em on our knees and everywhere else!

I'm sure if we really looked at the law books we'd find all kinds of "odd" laws.

My favorite is the one that prohibits the sale of alcohol with in a specified distance from a church??????What are they afraid of a drunk getting into church?  :huepfenlol2: There are still sodomy laws on the books and now gay marriages I mean WTF??????? :nervous:

If you want to see the definition of insanity just look under US Congress. >:( Balanced budget?? Those turds think they can get a gallon and a half of milk out of a gallon jug.

Delware is the size of what, a city block?  Alright, I kid.  But I wonder if this has something to do with the fact that it is so small and every surrounding state requires helmets to be worn.  I assume that when you ride, you cross state lines frequently and this would assure that you had the helmet on you to be worn in those states.
