Contact the MoCo directly. Unless the dealer has some kind of proof of what he's accusing you of ,your story constitutes Warranty Fraud. If you get no help from the MoCo call a Product Liability lawyer. And good luck

Boy, I bet the line of BS your dealer gave you (who is that, by the way?) sure makes you feel good about your Harley ownership experience, huh?  Hell, stories like this one pi$$ me off, and it didn't even happen to me, so I can only imagine what you're going through.

Glad to hear you came through it relatively unscathed, although it does not sound like the bike was so lucky.

Please keep us posted on what happens next.  Unfortunately, it appears you're in for an uphill battle. >:(

Dynasoar - Glad you were not badly hurt.  Could have been much worse, considering.

On your bike - I would give the dealer another chance - suggest contacting the regional Harley rep possibly if they act unsure.  If they elect to not warantee the work, plus your medical/towing/etc. expenses - I would sue. 

They are giving you bullchit respnses so far.  All the service guys at all the dealers (quite a few)I have spoken to know the 110's are too lean and too hot when set at stock.

DYNA glad to hear you are OK. I think your dealer is throwing the pork to you. Have it towed to another dealer.

Have the rear oil jet checked, it is located in the right half of the case. It squirts oil on the bottom of the piston to help lube and keep it cool. It may be clogged or non existent.

In addition to items mentioned earlier, I would recommend you copy your bill of sale, all receipts for mods, your written warranty and print your previous  posts to this site wherein you referenced  the oil gas problem. also while events are fairly fresh in your mind write down exactly what has transpired since you first suspected a problem, what you were told by anyone at dealership or other mechanic shop, dates, who was present, if any ecm mods tell your attorney and make sure he knows of issues re the afr and as mentioned earlier, the rev limiter on bike.  I would also be careful concerning what you say to anyone about this incident, even here. That's one sad story. Good luck in your journey ahead. Lot of knowledge people here that have been down that road that I'm sure can give great advise.

I'm so glad you're OK Dyno. Please pay careful attention to the above quote. You are facing a dealer more concerned with covering his ass than your safety. You must begin to do the same and cover your own ass. Do not deal with this yourself. I don't know if you've done any mods, but do not state it here. PM someone/myself to discuss this, to make sure you are clean in this. You have a brand new bike, notorious for overheating issues and produced by over lean conditions, as issued by the MoCo. They damn well know that. It's well documented here, as well as many other places, including HD's own warranty claims. Copy as many threads as you can find and bring this history to your attorney. Research other HD forums and collect as much documentation as you can. This is about the most insulting treatment by a dealer I've heard to date. Make them pay!!! Hoist! 8)

The damn thing has a rev limiter.  It's engineered to set its own limits.  You CAN NOT spin it faster than Harley Davidson deems appropriate.  Remind them of this when you ask them how far up their ass a saddlebag might fit.

If they respond by saying you're not supposed to spin the mill above some lower RPM limit during the early miles ask them if they've ever been through the assembly tour at York.  Your bike and, according to the company's tour rep, every other goes on a dyno and gets spun out before it ever gets boxed up.  If it's good enough for Harley it should be good enough for you.

Dynasoar-
We're all trying to help here.  In reading thru your posts you have been dealing with Mid-Ohio HD in Springfield, Oh and F&S HD in Dayton, Ohio.  In the one post you said F&S was helping out and Mid-Ohio was not.  Which dealer did you buy the Dyna from?  Which dealer is it at now?  Which dealer did the reflash of the ECM you described on the March 26th post?  That post said you ordered a SERT and V&H true duals for install at 1,000 miles-that hasn't been done yet?  I am aware you have been complaining of a fuel smell, running hot, and going into the heat mode.   If it is still stock, maybe the one dealer did a bad "reflash"?  The dealer that did the reflash said he had had 3 110's go down in under 2,000 miles.  I know I'm throwing alot out here after reading thru your posts.  Help us help you with more information.  You shouldn't be going thru this dealer's BS.   Good luck!

DS, Sorry to hear about your problems. I hope you are ok.
For what it's worth, I would make a copy of all your posts here re: fuel smell. Remember they're day & time stamped. Give it to your attorney. Don't let them push you around. They have deep pockets and insurance just for this type of thing.

Dynasoar- One word of advice to you  (or anyone for that matter), from someone who has spent *,***,***.00"s  of dollars in legal fees, no matter what they say, they are not YOUR ATTORNEY, au contraire, you are their MEAL TICKET.  This is true 99.9% of the time. If you (or the defendant) have any money, I guarantee the combined legal costs will be AT LEAST what you are litigating for. that is the way the system works. If you are lucky you will break even unless you go on contingency.  I know this upfront going into any litigation-I do it only for principle, not for profit (or to break even). 

More often than not the only parties that come out of litigation whole are the parties with: 
a) no money; or 
b) all the money.

At least on the Left Coast. That is just the way it works, its all about the money.

Anyone disagrees, PM me with your attorney.  I will have a ton of business for them.

If you are an attorney, and disagree, be forewarned, I have my LL.B from the school of C.A.S.H. and I know your program, i.e. you want to transfer as much money as possible from my account to yours. Period.

Not that it matters, its still BS.

Anyhow, isn't the official Harley factory break in procedure 500 miles, if so
whats the harm in a lil WOT now and again?

After talking to "THE VOON" last night about this. He (being a PHD HD wrench) stated to me that the dealer that told DYNA this story is full of BS.That the motor was out of the break-in period. They are having some problems with this motor running hot. Although he has not seen any of the BAD 110's as of yet (it is still cool where he lives) he expects to.

Not going back and reading all of Dyna's past post till just now. I was very suprised to read about the gas smell in the oil. While I agree to some extent that during break-in it is very posible for the smell to be there. After a couple of hundred miles it should not. Also given the high heat that these motors give off it would help evaporate any fuel in the oil. If the smell was as bad as Dyna said it was I would now suspect a broken or missing ring or bad (clogged) or missing oil jet in the rear cylinder.

I also think once the MOCO rep looks at the bike it will be taken care of through the warranty. I know a lot of people have had warranty nightmares in the past but I don't think they have a leg to stand on in this case.

AGAIN WHO IS THE DEALER?????????
