Glad to hear you are OK.  Unfortunately everything that needs to get done is going to delay and Believe it or not, the doctors always ask if you have a lawyer hen you get in an accident.  It sounds like it could be a total where the damage exceeds 60-80% of the value. 
The best case is one call from the lawyer and you will get a new bike.  Let them investigate the root cause while you are riding.  I had one run in with the MOCO and they are very responsive to two words: Lawyer and injury.  You got the injury now get the lawyer.  They caused your injury, you should get a loaner bike if you decide to fix that one, which I would not. 
This is an example of why I would not go the SERT route.
Dyno, good luck and keep us posted carefully.  Being an owner of a TC 110 this is not a good story.  The situation could have been much worse.  I better tell my wife about this motor issue and what to do, just in case.

If it were me, before I got a lawyer, I'd do what some of the others recommended, tell the dealer you want written documentation and proof of any condition they found that would void your warranty. Tell them if they are refusing to fix your bike, your going to MOCO to get this resolved. Hopefully they back down, but if not, I'd proceed with MOCO before paying for a Lawyer, see what they can do, then after you exhaust all the options that don't cost you anything then think about a lawyer!

It sucks, but glad you weren't injured bad!! Good Luck!!

Go directly to the horse's mouth - the Customer Service Manager at the MoCo. That's what I did when my dealer gave me a bunch of BS regarding the circuit breaker on my '03 ultra. To make a long story short - I crashed (minor damage - thank gawd) because of a defective breaker (that the dealer said they replaced which they didn't). Dealer refused to owe up - I went to the MoCo and got MORE than what I was expecting - I was highly impressed. It might take a few phone calls and an in-depth letter to all of the higher ups in the company. But the squeaky wheel got the grease in my case - just don't give up. Then drop the dealer faster than a bad date and find one that you can work with - they're out there. My local dealer has lost tens of thousands due to a twenty dollar breaker. Truthfully, I wonder why he's still in business - I'm not the only one he has screwed.

Yea, hopfully when you ask your dealer for written documentation you can send to MOCO, they'll back down!!! Also let them know you going to post this incident on several large Harley chat sites like this one, naming them in the post!!! Smack then between the eyes!!! Loss of $$$$ is all many of these dealers understand!

WOW!!! That had to be some ride.  Glad to hear you are OK and sorry to hear about the bike.  Agree with all the suggestions above to pursue.  Don't let the dealer or the MoCo walk away from you on this one.  There are alot of 110 owners out there who will help you pursue.  Keep us posted and best of luck, Otter

Wow, a lot of people replied!

I have been working with the dealer most of the day. The guy I talked with yesterday is apparently new (this isn't my normal dealership, but one close to where I crashed). The owner of the dealership called me this morning after he found out what I had been told yesterday.

He apparently lurks here and other boards and asked if I could refrain from naming his dealership until this situation is resolved. I plan to give him a chance and will respect that request for now. I mentioned that I'm a member here.

Then he drove almost 100 miles to my house and drove me and my brother to his dealership.


We looked at the bike with two of his techs. One of the techs stated "...the rear jug is missing its gallery outlet." I have no idea what that means. I probably should have asked. I'm sure someone here can explain what a gallery outlet is. ( I was thinking art store)

I told them about the fuel smell in the oil. The techs both agreed that was because of the BROKEN rings in the rear cylinder. They both looked at the pipes and saw the layer of burnt Syn3... also accounted for by the broken rings.


The inside of the rear cylinder was purplish-black. The ceramic on the spark plug was dark brown at the bottom and faded to white towards the top. The heat-shield on the rear pipe was a pretty metallic blue and there were sags in the pipe where it started to melt. I also noticed the front cylinder was oily, while the rear looked bone-dry.

As for the rest of the bike, the right side of the tank is smashed. The forks are bent. The front wheel is broken. The bars are bent. The throttle grip is missing. The right foot-peg sheared off part of the frame-tube when it contacted the road. The air-cleaner cover is smashed. The pipes are flat. And the rear fender is curled under and sticking into a flat rear tire.


I was told that the important people at H-D are now aware of the situation and that I need not worry. He told me that I should have a brand new bike as soon as feasible. I should also have a loaner by the weekend, but it probably won't be a SE anything.

So far, I've been treated as I expected to be. We'll see about follow-through.

I fared better than what one would think after seeing the bike. I wasn't expecting the rear wheel to lock up like that. It caught me off-gaurd and I didn't have time to pull the clutch. Shouldn't it have free-wheeled? Oh, and I got a free lunch out of the deal.

Sounds like they are trying/going to do the right thing. Seems there was several issues w/this motor. Remember to document everything your are being told and keep records. Also would be good to get pictures of what they are telling you is wrong w/the motor. Give the dealer a chance as it seems these issues may fall in the MoCo's lap. Keep us posted.

Great news DS! It sounds like you're on your way to a proper resolution to this. Don't underestimate the power of this great site! You can be sure if this dealer lurks here, and knows the strength of the knowledge and documentation here, that of course he doesn't want his name mentioned as the bad guy here. Always blame it on the new guy, I guess! Whatever. They know you had all the back-up in the world to support your case and cost them 10's of thousands of dollars in business if this got out that they tried to screw you. I'm glad this will be easy instead of difficult to resolve. Who needs the grief of fighting with them for what you have coming in the first place. Thanks for the report. That was a far bumpier ride than I'd assumed from the earlier description.  Thank goodness you personally aren't any more banged up than you are.  The travel gods were with you that ride. 

Also thank those travel gods that you (apparently) merely suffered the indignity of a service writer/clerk/ex-employee who was simply speaking without benefit of insight, training or intellect.  Whether the prospect of public opprobrium here had any impact on the shop principals now far more pleasant reaction we of course can not know.  That it didn't hurt is certainly obvious.  In any case, congratulations on the certain easing of the mind you must now be feeling and satisfied well-done to the dealer/dealership for the efforts you've described (to date).  You certainly must be feeling much better now.  It's just too bad the same dealership wasn't quite so pro-active at your first complaint of the fuel smell.  A significant degree of damage and potential injury would likely have been avoided.

No, not a free wheeling situation if the drive train locks up.  Short of something physically separating we move via direct drive.  So should chit happen the entire drive train locks up.  It is one of those things you have to tell yourself to remember; any hint of the motor shutting down (for any reason) while in motion you have to go for the clutch.  After enough miles and time it is as instinctual as the counter steering most people never knew they're actually doing.  But only if you'd thought of it first.  Otherwise a sudden shot down can and will ruin your whole day.

Once the matter is resolved to your satisfaction please detail Harley's official explanation
for the cause of this product failure.  I would also appreciate your refraining from agreeing  to any confidentiality agreement with Harley that would prevent you from passing along safety related info to the members of this forum. (They like to do that in product liability cases.)

Finally, and when appropriate to do so, please ID the dealer that has stepped up to resolve this problem.   

Best of luck for a speedy recovery and resolution.

He was likely speaking of an oil galley.  A pathway for oil flow.
