Beware: Inferno 2010 FLSTSE in Branson MO

If you see a 2010 inferno FLSTSE for sale in Branson Missouri beware, i won it on Ebay and i live in Australia after giving him $1000 deposit by paypal and asking for the lien holder details to pay out the balance he was stalling me and then tells me he was offered $2000 more and sold it.
He wont return my deposit because his brother the ebay account holder told me he is a Law officer and its a civil mater at best,i need to fly to USA to fight it and that i took more than a week to complete the transaction

You are protected thru paypal. Start a dispute with them. They will contact the seller and if they find him in the wrong they will charge his account the 1000.00 and return it to you. Good luck.

Hi,
i am not protected through paypal because its a deposit and the transaction was not completed and its not a tangible item, ebay says its not covered either because the transaction is incomplete also

This doesn't make any sense to me whatsoever!!

If you place a good faith deposit and the buyer backs out of the transaction for any reason you are entitled to a full refund.  Otherwise people would start using eBay and Paypal to scam deposits from transactions all the time.

I would waste no time contacting the FBI and other agencies. 

I would also resubmit my claim in writing with eBay and Paypal and attach your written complaint letter to the US Federal agencies. That may give them the incentive to get your money. 

Other issues:

The correspondance you received from eBay seems to be weak grammatically.  Are you positive that they sent you the replies?

To be sure, I would also, call the complaint in using the eBay and Paypal contact numbers from their site to confirm. You should reference the complaint number you should have been given.

Also consider that IF the brother is really a Police Officer he won't want you to file a complaint with his Police Department Internal Affairs Department. Especially if it turns out that he really isn't a police officer after all.

I hope you get your money back soon.

eBay and Paypal have changed their policies somehow.  Between three and four years ago I sold a bike on eBay with a $500 deposit set up just as this one was.  The guy paid the deposit then bailed on the purchase after I trailered the bike 600 miles to his front door.

If for no other reason than to cover the cost of transportation I refused to refund the deposit.  The guy filed a Paypal claim and got it back.

They may have changed their rules.  But the mails above seem not to pass the sniff test.

Moral support is all well and good.  But there's no way any third party has any impact on Paypal refunding the guy's deposit.  If cheerleading helps I'll wear the uniform.  But all the rah rah will only make us feel good.  The guy just needs to go through all the steps available to him.  Here's my good wishes that it works out for him.

Getting the info out there that this seller is one to be wary of (once we find out who he is, contact info, etc) we simply plaster it all over the internet for the world to read.

I go through great pains to assure I NEVER short change anyone. I as a buyer expect the same. That does not always happen as I found out from a set of wheels I bought... but whats done is done...  however, in this case, this jackwad took a guys deposit then sold the item to someone else for more. (allegedly) LEts find out and see where it leads...

This makes no sense at all.  "Non refundable deposits" are for the protection of the seller if the buyer backs out - not for the protection of the seller if the seller backs out.  Of course, I'm sure EBAY understands this distinction also...  Short of the OP supplying a few more details, this all seems a bit suspect.

If this is all for real, I'd consider contacting an attorney in Branson ... Even if the attorney cost a thousand, it would be worth it to me...

I agree.  But none of that would help this gent get his refund.

Just spent a few minutes doing completed auction searches at eBay.  The completed auction search tool doesn't search back an extended time.  Looks like about a month.  But during the time frame the utility reaches didn't find this listing.  In fact didn't find any 2010 Harley of any kind sold within 50 miles of Branson.  A Craigslist search for the areas of Springfield and Branson, MO and the adjacent areas in northern Arkansas didn't find it either.  The gentleman will need to provide specific listing information to know who the seller is so he might be avoided.
