I had several oil leaks head gasket, rocker covers and peeling powder coat repainted a couple time with new spots popping up all over. My dealer was very much on my side pushing HD to do the right thing. The HD rep originally met with me and said they would replace motor, then called me and wanted to confirm when this was completed we were all "done with this", I said of course unless it leaks or peels on the new motor, he then said I might as well replace the bike. So fo the diference in price of 08 vs 09 plus tax on the difference, I swapped my 18 month old Ultra with 18,000 miles for a new one, must say couldn't be happier 09 head and heals above the the 08 in ride. 09 has 10k miles on it and not an issue with powder coat or oil leaks.
And of course they gave you a big discount to compensate your loss?  What a cop out for HD, no wonder more people go away from them what a shame, at least my old AMF models only leaked oil the paint did not peel off the motors, come on Willie G get it right

I think that was more than reasonable, I put 18k miles on a bike, used it for 18 months and for around $500 was given a new bike or they would have fixed my old one. What more were they to do for me. Every time bike was in for repair I was given a loaner, too.
I am very satisified with the resolution to the problem.

it's been my experience that they'll blame it on something that makes it your problem , I've got an '09 s.e.road glide , with chrome issues ,( peeling & pitting ) i was just informed after a 3 week response time , that harley is not going to cover it due to the humidity in fla. and suppossedly lack of sufficent maintainance , if their respondse is that lame ,maybe they should'nt sell their product in so called humid climates , to a consumer who actually intends to ride the bike !!! this is the seventh new harley that i've bought since '97 when i got back into riding , and even though i love them i'm tired of the lies & deception that comes outta everyone affiliated with the "motor company "to the point where this is probably the last Harley Davidson that i'll own . But hey maybe they'll take care of your issue , i hope that they do right by you ; just don't count on it!!! GOOD LUCK , YOU ARE DEFINETLY GONNA NEED IT . POSTAL  52

I am going through the "ropes" now as well.  I was told by my regional rep that a case replacement was in order only to hear that she was overruled and that I will get the "patch" fix.  I am trying to keep my cool and understand the process but all I got from CS was alot of lip service.  They did acknowledge that there is a process and this was just the first step.  They said something about "guidelines" after the fix that the dealer uses to evaluate the repair for acceptability.  I asked for a copy of them and was told that it was property of the MOCO and I could not have a copy.  I know it sounds like me bitching but they really need to keep all of us happy.  We are not share holders or dealership owners we are the ones that make it all possible for them....we are the customer!!!!!!  Any advice on what next or what to do would be great

That's a crock.  If it's a specification or process that applies to the application of your warranty you are entitled.  You are one of the parties to the warranty contract.  If they're applying a specification to deny work under that contract they owe you the specifications.

This was pretty much where mine was on my 09 ultra .. 7 months later they finally replaced the cases.  They tried some spray on paint, but it didnt stick and it looked like hell.

Hope you have a better resolution period than I did.

Looks like this problem continues at least through the 2011 CVO models.  See my post at http://www.roadglide.org/showthread.php?p=112371&posted=1

OK, after many calls and emails, HDMC has decided that they will NOT replace the cases or the engine but will only offer "touch up paint process". I have copied the paint process they are recommending below. With over 75% of the engine cases now affected, I don't see anything good coming out of this. Nor does the dealer. They do not want to go down the touch up path. They know that the exposed metal on the cases has started to oxidize and will forever be a problem that they will have to deal with.

Dealer is exploring alternative courses of action but I don't have high hopes. Dealer is sympathetic and helpful but appears to have limited options. I guess the good news here is that HDMC has acknowledged it to be a warranty issue. The bad news is that it won't get repaired anywhere near the level that should be expected.

Bottom line - DON'T spend the extra $$ for a CVO. The quality of workmanship, at least in this key area, is less than a non-CVO. The quality of customer service is also much lower than I expected. A complete waste of money and a total pain in the a$$.

Email from HDMC Tech Service to Dealer:
Tim,

I've had the file reveiwed per your last email. At this time I've attached the paint repair pdf file to help make repair to the cases, as it's our right to make repair vs replace per the warranty guidlines.

Repair Process from HDMC:

How to Repair Case Paint
Damaged crankcase or transmission paint may leave a bare spot of aluminum that ruins the overall looks of the powertrain. At the Motor Company’s 2001 New Model Announcement the Customer Service department demonstrated a simple procedure for repairing case paint in the field. For those of you who missed this valuable demonstration, this “How To” article is provided.
Tools & Supplies
You’ll need some basic tools to complete this repair procedure.
• Scraper
• 100 & 180 grit sandpaper
• Harley-Davidson Texture Black paint (P/N 98606-BF), Silver Bead Blast paint (P/N 98606-BY), Granite High Temp (P/N 98606CTN – ’08-later CVO) or Medium Gray High Temp (P/N 98606CPM – 1200N)
• Newspaper
• Heat gun
Step 1
Scrape off any loose paint from the damaged area
Step 2
Sand the aluminum with 100-grit sandpaper and feather the edge of the paint with 180-grit sandpaper
Step 3
Create a funnel with a newspaper to direct the lightest possible spray of the appropriate paint to the damaged area. (Note: Remember to paint in a properly ventilated area.)
Step 4
Use a heat gun to dry, not bake the paint. Repeat steps 3 and 4 several times to create a seamless repair. (Note: Please follow instructions
and warnings for heat gun use.)

Looks like plenty of evidence for a class action.

Hey, you paid for an expensive bike and the dealer is not fixing the issue.   Other option is lemon law.  Keep taking it back until it is fixed properly, count the days and then work the lemon law.

IMHO, that "repair" process is a friggin' joke that no one familiar with painting aluminum would even waste their time on.  And the "process" was meant to be used for small damaged areas anyway, not an entire engine with defective factory paint.  I wonder if using a shade tree touch up process would be OK if the paint was peeling off the fuel tank or fender?  How many touch up bottles and tiny brushes would be required?

I'd suggest consulting with an attorney who is well versed in warranty law.  Unfortunately, if the lemon law in VA is the same as I remember it from years ago, it won't be of any use for cosmetic items.  But there are plenty of other laws on the books a good attorney could use to your advantage.

Good luck.
